    Picked up a load yesterday. Bulk produce directly on floor. It is scheduled to deliver Thursday 6am. After truck is loaded, shipper says he receives phone call saying buyer on other end has said they are cancelling the order. I live about 45 minutes from shipper so I took truck home with certificates of origin and he will fax bill of lading and customs paperwork to me when he figures out where this load is going to go. I have signed no BOL or any other paperwork at all.

    What do I do when he can't figure out where to take this shipment? Have a sale out of the back of the truck? Take it back to him and say take it off? Won't be doing this again.

    You should have had a BOL before leaving the shipper. If no BOL then the shipper should take it back off your truck.

    Yes I know I should have gotten a BOL from shipper. I waited there an hour after they were done loading and he still didn't know where it is going. If he doesn't know where it is going by sundown today, it is going back to him. He can continue to gripe about the crappy service he gets from his other drivers. This isn't worth putting up with. Just costing me money.

    From what I see from your post having no BOL means truckload sale this is your load so if the shipper won't take it off , and you never stated what it is , you can try a regional market or sell it yourself

    Bulk bell peppers in bulk. To my knowledge, there is no regional market around where I live. These all get shipped to NJ/MD/DE/PA area and get chopped up, frozen, re-sold. They are straight out of the field onto the truck. The peppers bought at the grocery store are all greenhouse grown and packed in boxes. The distribution centres for the local grocery stores (to my knowledge) do not accept anything in bulk on the floor load like this. The closest market (on the CDN side of the border) is in Toronto, I have been there lots of times and have never seen any loads come in like mine. It is 2:30pm now and they are still figuring it out.

    If they hold out for too long and I decide it is going back to the shipper, what is to say he even has the means to unload it? At the receiving places (NJ) they float them out with water. Another place uses a bobcat to unload them. The shipper has ... neither.

    Beginning to think I should be calling insurance company to let them know of possible fraud here. Am I liable for a claim even though they have no BOL or any other paperwork signed by me?

    Let's say, by the end of the day today, broker and shipper still don't know what they are going to do with this load. How much do I demand for truck sitting with a load in it for storage? I am thinking $400 per day. It is not spelled out in any terms, this broker doesn't have any broker agreements previous to setting up with them, nothing. Just put them on your insurance, give them copies of your authority and away we go. How is TONU typically calculated? Would this classify as TONU?

    First mistake was leaving without a BOL. second mistake (which happened first) was not getting a clear cut rate sheet with exactly where this load is going. Third, is not enquiring immediately what TONU/Detention would be. I'm surprised they even let you leave without a BOL unless this operation is some sort of scam (i.e., a purchase order was released via fax/etc to the buyer and now he's looking to who can give him the best rate).

    I'd tell him he has an hour to get a TONU/Detention/layover in writing or else you'll start dumping the load. Or, a destination with some generous rate to get there. You have nothing that says this load is yours.

    I have seen this back in the seventies hauling watermelons. They would load them and head you north, then call you in a day or two and tell you where to take them. We always had a BOL though, that is the law anyway, had they pulled you over for a DOT inspection this would have been written up. Back then though we had previous relationships with the broker and knew the money would be there. They just didn't have them sold at the time of harvest. I would ask around and see who else has done business with this broker for starters, before I burned a bridge.

    That's what that reminded me of I wasn't trucking in the seventies but had similar situation where i got stuck with a load of watermelons and I was told by a lawyer friend the load leagaly at that point was mine so I went to a parking lot off route 6 in Bristol , CT and had a melon sale , I got lucky and made more than I expected to but that us not always the case , and these days who knows !!
