Prehires with a *misdemeanor* conviction: California Central Valley?

    Hi, first post...so let me just get straight to the point ,and give ya'll some information relevant to my situation. And here is a pre-emptive "sorry-for-posting-about-needing-a-job-with-a-criminal-record" statement..

    I'm scheduled to begin Western Pacific Truck School in Modesto this month; however they are weary of enrolling me until I can get at least one (but two preferably ) letters of pre hire.

    I'm having difficulty finding some companies that will hire me, due to the fact that I'm on misdemeanor probation for six more months (informal, unsupervised, with no travel restrictions)

    I have a MISDEMEANOR conviction of domestic violence from January 2010. A misdemeanor conviction, because nobody actually got hit or injured, and no marks were apparent. It was basically a pissed off spouse calling the cops on me to "talk to me," when we were having an argument over child custody; but california state law mandates an arrest, when one person dials 911. To add to that, she asked the DA to drop charges, but the DA proceeded anyways, because it's their policy to proceed with the case anyways. It's considered "assault" to raise your voice at your wife :\

    So I pled No Contest and got 36 months informal probation, anger management classes, and 30 days in jail that I didn't actually have to serve. It wasn't a "wife beating", so much as it was a mutual argument between both of us.

    I'm wondering if anybody knows of any companies who are willing to consider me. I'm 25 years old, I have 0 points on my driving record, I have no tickets, fines, moving violations, or accidents of any kind on my H6. I basically have a record of perfect driving.

    Any leads? Thanks, sorry for the lengthy post.

    It's going to be a problem because it involves "a crime of violence".
    Please don't bother going to school as you have about a <5% chance of getting a job with a DV conviction.
    ...this is not to mention the bias you'll experience from recruiters and/or decision makers.

    Domestive Violence law is anti-male.
    Most DA's have "No Drop" policies, if she changes her mind.
    I'm sorry, but you need to move on from trucking as an option.
    The school is being honest. Most will lie and say something to the effect, "Oh that shouldn't be a problem.", only to have you burn $5K for nothin.

    That's a little discouraging, considering the fact that some companies will hire those with a felony. This is a misdemeanor, and there wasn't even any evidence to substantiate the case. She got mad, and dialed 911, and the police came and said "oh, you're a man, off you go to jail."

    This has ruined every single job I have ever interviewed for in the past three years.

    I think the fact that you are still on probation will hurt you more than the offense. I would wait until your probation is over and then take another look. Anything that concerns violence or drugs is especially problematic for carriers. At one time California had a program to get felons out of prison and into a truck as a driver. You might check with your probation officer, explain the situation and see if he can help. I would not spend my money without having some assurance that I could get a job, if I were in your shoes.

    Hmm, I don't even have a probation offier. Just a clerk that maintains the files at the probation office. It's misdemeanor probation, unsupervised at that--I've never, ever met with a "probation officer".. and probation is basically telling me "pay your fine and we will recommend to the judge that you get off probation early and expunge your record." Well, that's all fine and dandy, let me come up with 1,500 dollars without a job so I can pay the fine, so I can start working... you get the picture. That's the first and last offense, the only thing on my record.

    I'm guessing my only option is to zero in with some smaller companies then, right?

    Yeah, any crimes having to do with theft, drugs or violence are given extra weight, and your charge happens to have the word "violence" in it, and it's domestic violence which means you struck your wife, a helpless woman (in people's minds). Plus it's pretty recent in time.

    Keep applying; try CRE, PAM or Western Express, but don't commit to school until you have pre-hire's in hand.
    If they won't take you no one will.

    Assuming they haven't pulled your passport for missing CS payments, you might want to look at going abroad, perhaps the orient.

    I should also mention that I'm getting my CDL paid for through EDD, who are fully aware of my 'criminal background' and even they feel that I stand a good chance of getting employment, due to a completely perfect H6 printout.

    Well, now is not the time to become discouraged. I've got a kid to provide for, and another one on the way next March. Had the judge specifically said, " I sentence you to a lifetime of unemployment," I'd have made the DA prove his case before taking a plea deal.

    It would help if you could pay the fine and get your record expunged and it would be a non issue. I know, it is like the cart before the horse. Check your local state employment office and see if they can help you find a carrier. Many carriers will list their jobs with state employment offices.

    I would venture a guess that your best bet would be to call companies based in Cali, not just a terminal or go talk to terminal managers. They are more likely to understand the conviction being based in the state it happened. When you have any kind of conviction explaining it over the phone or writing doesn't always work, and a DV conviction in Cali may have different levels of charges where in another state it may all be felony. So talking to managers/companies in your state would be the best option. Also see if there are any container companies or small locals/construction that will hire you.

    I think the main problem is the violence thing...companies see that and think.."BAD TEMPER" and they know that the trucking industry can and will cause an otherwise calm person to get more than a little mad at times. They see it as you "may loose it" with a dispatcher/trainer/ co-worker, or GOD forbid a customer...and most aren't willing to take that chance. I'm not trying to discourage you, just be honest... it is what it is. Keep plugging away at at the potential pre-hires and maybe you'll get lucky...Good luck!
