So many drivers "quit" while under a load and get a job within days so I wouldn't worry about it to much. Way to many companies out there that will put a driver to work whether its otr or local.

And people question how the industry got into the shape its in? LOL!!!

Some companies may claim they allow drivers to change trainers but that's not necessarily true especially with big companies who hire more trainees then they have trainers. If a situation is seriously bad i'll tell people in second get off. Some will try and force you to stay with a trainer. Werner pulled that with me and I has some serious issues with my trainer including he couldn't keep his hands to himself which was my main issue. Truth be told I was scared of him but tried not to show it. To the end made up excuses for him and on top of that even though I thought it'd be safer to wait until he left to really tell them what's going on they made the situation go from worse to terrible by having someone else call him and tell him that I was making accusations towards him while I was still on his truck and he was sending me threatening texts while I was on the phone with them. They flat out told me if I leave find my own way home and that's exactly what I did. I wasn't waiting for him to come back and do something to me and apparently Werner didn't have a care in the world so I left. Made sure to move his truck too and kept his key and locked the truck. Using the last of my money I caught a taxi to Greyhound. I called a teacher and told him what happened and couldn't believe all of this so he listened on 3 way while I was speaking to safety and he ended up madder than I was and just blurted out he was a lawyer and recorded that whole call and was going to press charges. They did a complete 180 and very apologetic offered to send me money and reimburse me for everything. I still went home especially since hasn't slept in two days because I didn't want the trainer to try anything and I was extremely tired plus I needed to decided if after going through all that was this even worth it to continue. In serious situations especially if a company isn't going to help I suggest leaving screw a process. Load or not. My safety is way more important than anything they can put on my dac.

I'm confused, I take it he already has a license? He is with a company trainer to learn how to do the job now? The phone and texting is happening while in the passenger seat? He falls asleep in the passenger seat? If yes, he obviously is comfortable with your sons driving skill so far.
Whoops just re read the post. Texting while driving is impaired driving as far as I'm concerned. -
I'm the OP, and I noticed I left out that my nephew does NOT have a CDL(have since edited OP). He only has a CDL learner's permit. LadyTrucker2go, you have some good points. One of his concerns about telling anyone in the company about this is he may end up with the same trainer that is now angry with him. In your case you may have a winnable sexual harassment lawsuit. Anyway if he does complain to the safety department or some other higher up and they do nothing, then who can he contact? I already text him to not quit under a load though it makes no sense to me that a student is responsible for a load that the trainer can just as easily deliver alone.
Thanks to all who answered. I will pass on the advice and update when I find out more info. Oh, one more thing. He has mentioned being tired when driving at night after being up 18 hours or more, and said the trainer does take over, but he says an insinuation is made that he cannot pass the training if he is unable to drive while fatigued.Last edited: Nov 6, 2012

Since everybody else seems to have missed that, I figured I'd emphasize that a little before giving my response.
#1) HIGHLY illegal! Since your nephew only has a learners permit, he is only legally able to drive while there is a licensed driver sitting in the passenger seat who is awake and alert. A sleeping licensed driver may as well not be there...in which case you have an UNLICENSED DRIVER at the wheel of a CMV.
#2) A VERY bad habit. The FMCSA has really cracked down on phone use while driving...and has levied HUGE fines if/when you are caught. Get in a wreck? Your cell phone records are sure to be subpoenaed and if you were "distracted", your culpability in the wreck skyrockets.
#3) That must be a REALLY old Qualcom device. Most companies anymore utilize the feature where they can disable certain functions while the truck is in motion. Of course it could be possible that since this is a truck which generally has 2 people in it, that feature may have been left unblocked so that the PASSENGER could still use it. Even so, it is an unsafe practice and really is no different than texting on a cell phone.
#4) Trainer is falsifying the logs...and the student is allowing it to happen. If your nephew is tired, he needs to stop the truck and get some rest. Period. If the trainer doesn't like it, tough spit. Would the trainer rather end up upside down in a ditch after the tired student fell asleep at the wheel? Obviously not...so be SAFE. If SAFETY is not the #1 thing the trainer is teaching, FIND ANOTHER TRAINER!!!
#5) Paper logs had to be completed in your own handwriting. Nobody else was allowed to make changes to it. This is a HUGE problem with e-logs, as there is no way to verify that the driver is completing his own logs and nobody else is tampering with them. If I were the student, I would report this activity to the company, ask for a new login ID/password that the trainer WOULD NOT know, because that might be the only way to stop the trainer from doing this.
I must have seen your original edit....and thought it had been there when everyone else was replying. Oh well. To all those who replied BEFORE that info was edited into the OP, I probably would have responded the same as you. A lot of large carriers have such high turnover that they take a driver who JUST got his CDL and make him a trainer 60-90 days later. These trucks are usually treated as "team" operations, since there are 2 licensed drivers in the truck...even though neither person (trainer OR trainee) really has a clue what they are doing yet. It is kinda sad when you consider the fact that my DOG probably has more seat time riding in a T/T than a lot of these trainers do....but that's another topic for another day.
Bottom line, I made my original post after edit was made, not realizing that I had information to reply to that nobody else did. -
Call safety but if he bails he will owe for the driving school and that can be costly

Wow! That's just as dumb as when my trainer said you have to learn to drive on ice it's a part of trucking. Just when I thought I heard it all. This trainer must have the balls of steel. Saying that he's unsafe is a understatement. He's careless especially even about his own life. You'd have to be nuts to sleep while a unlicensed driver is driving. I can understand if the trainer thinks he's capable of driving and trust him and he actually had a license. I've never heard of a unlicensed driver training OTR before but I would assume a trainer would need to be sitting right next to the student at all times. This trainer sounds reckless to say the least i'd be on the phone in a heartbeat and i'd be getting my behind off that truck. If he gets into a accident and it's his fault and the trainer is snoozing both of them will be in some serious trouble.

i missed that part... if he only has his permit ( things must have changed) they should be on a range learning how to back up and such and doing city driving learning to turn and such... not be pounding down the road state to state,
