out service violation

    He should of got a Ticket for failing Rule 1 of the Super trucker code. COVER YOUR BOTTOM and or Donkey. Pardon my french. Rule number 1 and don't you forget it. Your Super trucker licence has been suspended!!

    Here's my log book officer, you'll see I have been "off duty" the previous 6 days and today this is my personal conveyance.

    The reason you weren't written a ticket is that way it's impossible difficult to fight.
    Police look like they are doing a meaningful job and another truckers looks bad. Data Q's is a joke and I have had I had to force them to remove two violations.
    Below you will see the FMSCA print that personal use is just that personal. Myself I would've asked for a ticket and not left till I got one or a clean inspection report.

    Instead of all the back and forth gessing, why not just ask the OP this; What was the last mark you put into your log book before you were inspected? Was it off duty at the Pilot, or was it something else. That last mark, and when it was put in will make the difference as to whether the ticket was legit or not.

    Do you really think he is going to tell us the truth. Come on we leave out information on purpose so we don't look so guilty.

    regardless of what he put in the book, the book was off-limits because he was off-duty

    i have a scale by my house

    while doing some personal stuff with the truck, i pulled in the scale and had this exact conversation with the DOT man

    if you are off-duty, you are OFF-DUTY

    now, if he thinks you are lying, he can write you a summons and you can fight it in court, but do not let cops intimidate you into thinking you have no rights

    the man was bobtail going to walmart, how much more off-duty do you want?

    he made the mistake of showing the cop his logbook when he didnt have to

    No court, since there was no citation issued. If you want your day in court, you must force the officer to write a citation.

    You have a 99% chance of being pulled over when you in a big truck. Bobtail, or with trailer. The first thing they ask for is LOG BOOK, DRIVER'S LICENSE AND MEDICAL CARD. You don't have to be doing nothing wrong, but they can pull you over for no reason what so ever. I bet the guy probably still didn't get a load for 3 or 4 more days. All that time in a truck and you can't draw a off duty line. You got to be kidding me. If that dude would of had a head on collision and died on his way to Wal-Mart, girl friends, movies. or the the fast food joint. No one would know anything except. 7 days are so ago he was a point A.

    e) Failure to complete the record of duty activities of this section or § 395.15, failure to preserve a record of such duty activities, or making of false reports in connection with such duty activities shall make the driver and/or the carrier liable for prosecution.
