Truck searches by DOT

Not knowing the laws and your rights, is why people get walked over by authorities.

 

Interesting bedding info. First "upgrade" I am making to my truck is a memory foam mattress.

 

border patrol doesnt have the right to go inside of your vehicle unless you give them that right or they have probable cause to enter (hearing little girls screaming or blood dripping from under your seat)

i never knew there was an actual description of minimum bedding requirements

i dont think my beddding is 4" thick

 

you may think you have rights but you dont..if they want to toss you up they will.. 1st they will ask you .." do you mind if I do quick search/ inspection of your truck ? then you say. no you cannot ...then they get a seach warrant and toss you up anyway..

 

Sir, I believe it is important for all of us to be at least familiar with these regs, as we operate under them every day. We don't need to know them by heart, but we do need to be familiar. They are not that hard to read and understand, normally. They are generally written in plain English and many do have official interpretations listed. I have never had a problem with asking and officer, or calling the local DOT office, for a further explanation of a rule, if I needed more information.
Nothing sucks worse, than to get a citation for a reg you didn't know about. Knowledge is power and the more knowledge, you have, the less hassles you face.
In the photos of my truck, you can see that I run full side pipes. Did you know that only 12 inches is the difference between them being legal, or being placed Out Of Service? Cpl. Robinson, of the Idaho State Patrol and I learned that, from a Federal man, on September 12, 2001. Luckily, I was not cited, but only placed OOS, until we moved them back a bit.

Read through them, its not that hard and empower yourself. At a glance, you will see that some do not apply to your particular situation. Do you really need to know about Designation of Process Agents, if you are an employee driver, or a leases O/O? No. But if you are a leased O/O, you better be familiar with the leasing regs, as they effect how you are paid and what information the carrier is required to reveal to you.
As to your bedding, add a couple inches of foam, on top, and you will be good to go.

 

Law enforcement can search ANY vehicle without a search warrant IF they have probable cause there is contraband or evidence in that vehicle. Period.

 

You contradict yourself. You have the right to say no, forcing them to decide to spend the time to get a warrant, or turn you loose. Now, the onus is on them, as they need "reasonable suspicion" to get the warrant, to begin with.
It doesn't hurt to keep the number of the ACLU, in my phone's contact list.

 

if the vehicle is in motion and the driver is checking it out if it bottoms out,who is driving the truck?but really do you have probable cause to get in my truck?did that in alabama and the guy asked havent you had a inspection before?I said yes my company has a crappy score and I get them all the time,but no one has asked to get in my truck.He said we was excempt due to safety checks.safety? or probable cause which will the judge uphold hmmm

 

But, as you stated, they must have "Probable Cause".
