Tinting on truck windows is legal

    Ours has been on since 2007 when we bought the truck 18 dot checks 2 level 1 16 level 2. We been wrote up 4 times with 3 of them citiations. oops 19 tiimes got dot last night at Joplin level 1 windows passed. We has letter from doctor stating she has photophobia which is cover under the american disability act which they can not act under 35.130 general prohibitions against discrimination. work with FMSCA and also appling for eexemption through them. I will keep you informed

    Ok so DOT at the 56mm in pa on Rt 80 east pulls me around back and gives me a quick inspection because I was over on my drives. Allows me to slide and problem solved. So I thought. Another trooper comes up and places a meter on the inside and outside of the drivers window and low and behold I am too dark on tint. Of course I knew this and then proceed to show a letter from the DR stating a diagnosis of BASIL CELL CARCINOMA ( form of skin cancer) on my arm and back. Suggesting that window tint in my CV would reduce the affects of skin cancer as I am at a higher risk. DOT officer smiles and then hands me a $112 citation and asked me to remove the tint and gives me a warning for overweight, license plate light, and not having log current to last change of duty status.
    The Statute is 393.60(d) "Glazing permits <70% of light.

    I am still working with the FMSCA to get exemption for window tint which mine is 84% tint and 16% light transmissibility. My wife has Photophobia wich I found out that the American Disiabilty Act recognizes. When I talked to the ADA they gave me a section 35.130 b 7 which states they can not discriminate for her medical condition. I been reading something about theskin cancer and I know that they are in the works to go from 30% tint to 50% tint. I am fighting a fine of $569.00 in Frisco Tx. This is what I am work on Today. I have filed with the U S Department of Justice against the City Prosecutor, the Office and his Supervisor. I also found out I can file a civil suite up to $50,000.00 for each of them. I am working also with Luke Loy (FMCSA) 202-366-0676 and you might want to talk to him. the number to the ADA you can get off their web site. Hope this helps.

    i'm not trying to be difficult or discourage your efforts, but why not just wear sunglasses?

    My wife does also were sunglasses along with her window tint. Since 2007 when we purchased this Pete with the darker tint on the windows see has noticed that she does not get the migraines like she do before. Read up on the medical condition Photophobia and everyone might understand more. Thanks for asking. Oh by the way the other reason we are doing this is for the $569.00 and they way they have treated us.

    Thats what we are fighting (working with the FMCSA) In fact just go emil from FMCSA 2/7/2013 and they need one more item from us to get the exemption I THINK. We have been working with them from OCT. 2012 on this. Thanks and we have file the complaints with the U S dept of Justice against these people.

    Well spoke with Luke at FMCSA today and he basically told me I am going to eat the ticket I got but I figured that already. He did confirm your statement that a person is in the works to increase tint allow ability to rise to 50% for "inter and intra state carriers within the next year hopefully. That would help because I really get some looks wearing long sleeve shirts in 90' weather. Didn't realize the difference the tint made until I actually took it off. A shame I can feel the difference even in the winter.

    Call the ADA and talk to them about your medical condition and see what they say.
