I disagree. Although you have an off-duty meal exemption which allows you to leave the truck and go off duty to eat this does not mitigate his being under the load enroute to delivery. His is still a Swift employee working to deliver the load. Any competent lawyer will have a field day with this. Swift is just doing what every company does in these days of ski high legal fights, trying to not be responsible. I'd like to see some media attention on this. Truck drivers are portrayed at times as vicious killers on 18 wheels or worse. Regardless of the tenure of that driver, he was brutally attacked and left horrifically incapacitated, then abandoned by his own employer.
I hate its been so long, but that lends to the outrage. I'm getting ready to stir up some poop with this.Hogwash and TheRoadWarrior Thank this. -
I think we should ban a group of our brother truckers and see what we can do. It dosent matter who you drive for he was wanting to become a member of a brotherhood that few understand about. Vets, Newbies, Wannabes we all need to stand by each and everyone of us. Truckers are a rare breed that only they understand. Anyone got some suggestions what we can do?

I agree.Back in the day long before I started driving and there was no such thing as logs,truckers were helping one another and with open arms.But now unfortunately it's every driver for him or her self.You can't even get 2 drivers to agree on what color the sky is.

Well that is what corporations want. If you can keep people at each others throats they won't be organized. I would love to see some media attention about this as well. There is absolutely no excuse for this driver to not even have recieved a single call from Swift. Not a single how are you? Not a card, NOTHING! He's lying in his bed and can't even push the nurse button.

That area of Perris is a crime infested rat hole, loaded with the local version of crack heads. If he was in a company truck, performing any sort of function, "off duty" or not, then Swift will be liable. I would run, not walk to an attorney. A "tattoo" really ? Some "mentor", probably had all of 6 months experience. The bottom feeders strike again. If the Dodgers have to pay millions for Brian Stow (severely injured during a Dodgers game by gang members because of a lack of security) while Brian was "off duty", then this will be a slam dunk for a good lawyer. http://www.nbclosangeles.com/news/local/Timeline-Bryan-Stow-Case-122459754.html
