Accident Caused by Chicane

    The title is even funny... :biggrin_2559: Really.. Accident CAUSED BY chicane ...:biggrin_25512: .. did the chicane move while this driver was going threw it ?

    Thats like saying the gun killed someone... leaving no reponsibilty to the person who actually fired the gun... or Man killed by SUV.. no mention of the driver of the SUV.. so apparently the chicane is a moving living thing that just wanted to mess with this one driver....:biggrin_25521:

    Face it if you slam into a ditch its your fault for failing to keep the vehicle under control.. whether it is icy, raining, snowing or dark it is the DRIVERS responsibility to keep his truck under control..

    If a car slams on its brakes in front of you and you hit it or go in a ditch .. is it the others drivers fault ? or was the driver behind him following to close ?


    I'm going to bet the driver will be issued a citation for "failure to maintain control of the truck" or "excessive speed for conditions" . and I will bet if this driver plans on claiming its the roads fault he will get :biggrin_2559: at...

    Its always someone or something elses fault ...
    I'm also willing to guess this person is a liberal... Just a guess... Personal responsibility isn't something they seem very fond of ....IMHO..

    Thank you for making this personal. Here's your sign.

    It is my intent to make the job of trucking safer. All accidents have root causes. The root cause of this accident was the truck was going to fast to make the turns need to be made. The driver was going less then the speed posted. He has 23 years experience and this is his first accident. I came along the accident and talked to him. He was not hurt but the truck was destroyed. The bridge company sent an investigator out to the scene. I talked to him also. He seemed to think the chicane caused the accident. The driver reported that the steering broke and he could not control the vehicle. Looking at the scene it appears he struck the concrete barrier and then lost control. The guard rail was destroyed.

    So, how do we make driving safer? If the chicane can be replaced with something safer we need to speak up. If it is the drivers fault and always the drivers fault then maybe we should just ship stuff by train.

    How come in post #16 you say "For all I know he is dead". Now you say you talked to him and is not hurt? Which is it? To the point I think you are right as in all accidents have root causes and to my thinking the root cause of this was probably driving through there too fast. Not trying to be too judgmental but if he was looking ahead and getting the big picture (Jones System?) would he have seen that there were obstacles in the road and slowed down to compensate for them?

    1.How do you know the driver was going 38mph ? cause the driver said so and we know drivers/people in general would never lie ..right

    To answer your initial question, i.e. is the construction company liable, I would google for similar accidents where construction companies (and D'sOT) were found liable and look into the details of those accidents.

    For my money, IF everything you posted was fact, then it sounds to me like there is plenty of liability to go around. In my county, a drunk driver crashed on a gravel road, banged himself up pretty good and wrecked his car. He sued the county for not maintaining the road properly and the county settled out of court. Anything can happen in court and there is truly only one way to find out.

    amazing how twisted our courts get

    in nyc, you cannot have razor wire along your fence wall, because a criminal won a case where he was severely cut up while trying to break in a house

    simliarly, if you plant a booby trap bomb in your home for burglars and one gets hurt, they have won those types of suits also

    but let a truck driver roll over in wind and ice in wyoming, he gets NADA
