My little bird informed me that there is a better than average chance that the FMCSA will issue the "Final HOS Rules" in the morning, Tuseday, 12.11.07. No details verifiable. Just letting you know to watch for a press release.
I'm holding my breath.
Wasn't the court's deadline 12.27.07 for this to be done?

The court deadline was for the 27th. Kind of an odd time if you ask me, while many folks are on christmas break.
What you are probably hearing about is the Senate schedule on hearing the case. Thats been postponed a few times.

I've searched the usual transportation news outlets, and have yet to read of any announcements made this morning by the FMCSA concerning HOS.
Oh well, it may turn out my little bird is a turkey instead.

Now we're settled for a while, but the plot does thicken. Who has more power, a panel of Federal judges, or, a government agency. -
Hard to believe but all they did was to say keep what we have while they study what they can make better over the next year or so through a new bureaucracy, you have to love um!!!

The DOT is not aruging the regulations. The court is arguing the FMCSA did not provide proper studies for the "new" regulations and the Public citizens challenged it. The public citizens can make this another opening in the courts (my simple terms, not knowing the court words
.
From what I understand we are at least safe for 6 months and more than likely # least 1 year! So relax, the current rules you are "breaking" are still in affect
What you should all do is read my sticky thread on the 11 & 14 hour rule, because to many of you are still violating it

The group that chalanged the FMCSA can not bring the current HOS to court agen, unless they have a new charge, the charge they had charged this time is that before the ruling of the HOS went in to effect the FMCSA did not allow any challenges to the changes, or offer any studies to prove that the 11 hours+34restart were effective. it wasn't the courts that took the hos to trial.
