Smoking ban in ND to include commercial trucks

    Even though my boss is not enforcing this in our trucks, I thought I would pass the word that HP will be pulling over any truck in which they see the driver smoking in. The only way you will get out of a ticket is if you can prove you are the owner/operator of the truck.

    Also part of the law states that all company vehicles must have no smoking signs installed so they are visible from the outside and inside of the vehicle and that all smoking related equipment has to be removed from the vehicle which means throw out the Cig lighters and ashtrays. Paste a no smoking sign to the door and dash.

    I don't smoke, but for solo trucks I believe that the constitutionality of this law needs to be challenged. Government is removing far too many liberties these days.

    I would use the citation to light my next cigarette. I think that all of these nonsmoking laws are bunk and if you can't smoke there then they should not be able to profit from smokers. I. E. The sales and taxes from sales of smoking related products.

    Don't get me wrong, I agree with no smoking laws where it applies to a work place or other public area where the smoke has potential to irritate others. My philosophy is that everyone has the right to do as they please, until their actions begin to limit the rights of others.

    They tried the same thing in Ontario, however the first time they charged a driver it got thrown out....as it can be proven that the truck maybe your workplace but it also qualifies as your primary residence. They can not ban you from smoking in your residence.

    Sounds like all companies in trucking should start moving out of ND and then not deliver goods to them. Your truck is your home.

    This is not true! The "consitutionality" of this has nothing to do with...IF your driving my truck & I tell you that you can't smoke in it,,,ya better be on fire if you are smoking! That company can dictate whatever rules they want if they own the truck. Your choices are 1. Obey their rules, or 2. Get off their truck.

    As far as ND goes, we shall see. Telling me that I can't smoke in MY truck is an unlwful law. (just like those signs on federally subsidised interstate highways that say "use of engine brakes prohibited by city ordinance") What's the definition of an "enclosed" space anyway?
    I could see it if the ASPCA or PETA want a piece of my ##### cause I have a dog in the truck, but she smokes too! She has the free choice to NOT get in the truck every time we stop so I'd say she doesn't mind my smoking? Granted her (border collie) options are limited. Option 1. She has a home, eats good, plays alot & is happy with me. Option 2. shes homeless.

    How stupid is this?
