Smoking ban in ND to include commercial trucks

    In Ontario Canada we passed a law for no smoking in public places a few years back. In the beginning, some businesses suffered. It didn't take very long at all before the same people were back in the restaurants and bars (not smoking in them) PLUS the non-smokers who now enjoy going more because it is a smoke free environment. Smokers just step outside for a quick smoke. Only 20% maybe 30% depending where you look, of the population smokes. Who would be smart to cater to the smaller demographic? In the end, I believe it is a great law.We also have the no smoking in trucks, except ours is for ANYONE, owner, company driver, whatever, doesn't matter, cannot smoke in a truck. However, if the company is registered federally, the law does not apply. It is kind of stupid and there was a whole bunch of hoopla about it when it happened here too. When it first passed the cops wrote some tickets for it. I have not heard squat about it ever since. I would bet the same will happen in ND.

    This isn't a political issue for me at all, I just was not aware that it included privately owned commercial vehicles. Give them an inch, they take a mile. ######. They pulled a fast one, on a state that prides itself on a hands off government.

    Huh? Double negatives and I am not anti anything, just wasn't aware how far reaching the law was.

    Roadmedic, they banned smoking in pretty much everything but bars a few years ago, That included no smoking in truck stops resturants etc. Bacially anyplace were the general public was allowed. Now private businesses could adopt any plan they wanted as far as smoking goes. Most of them designated sealed off out of the way sections with fresh air intakes etc for smoking.

    There is a small town in my area that had two bars. The one bar was owned by a guy that hated smoking and he built it specifically for non smoking drinkers. We stopped in there while on our bikes once and it was a really nice place but there was not a sole in the bar but the owner himself. We went across the street and that bar was hopping with people but then most all were smoking. We actually had some fun, I kicked back with a redbull and 7 up and had a good time. Nope I don't drink much anymore so no booze for me especially when I am on the scooter.

    After stalling actually reading the law, I finally gave it a look see. One problem I see in all this. down into the law is states that every vehicle used in employment must have a sign affixed to it that says no smoking. Now this ought to be interesting as to whether this applies to out of state owned vehicles. And if it does not, then that would mean the application of the law does not apply fully to any out of state vehicles, and therefore out of state business' and their equipment is exempt. If it does apply to each and every out of state vehicle and the occupants, then there might be a conflict with the interstate commerce act. This might be fun for an attorney in the end. There is no mention in the law that any out of state vehicle that enters the state must display the no smoking sign on the vehicle, therefore the operator could not necessarily be charged with a violation if there was no sign displayed to show that no smoking was allowed in the vehicle. I see the law suits coming now.
