ohio tried this a few years back. they wrote a #### load of tickets. i even got one. mine got thrown out as soon as the judge seend the report and my truck was plated in pa not ohio. most of them where thrown out and those that where not where refunded their money and their records restored when ohio supreme court ruled that a truck was not a public work place but a private work place and that as long as a truck was assigned to a person or persons they could smoke in it.

Well, that makes for some good precedence for when someone takes ND to court over this.

Wouldn't it just be easier for the government (state and federal) to post what we are allowed to do? Seems like it would save a lot of effort.

Some of our drivers have been stopped and warned already. HP was not going to start enforcing the law for 30 days. One of our drivers said that the HP was sitting on an over pass and came flying down and right behind him with the lights on.
So in light of that. I keep an unlit cigarette in my mouth at all times. Just waiting for HP to see me and pull me over. No law against having an unlit cigarette in my mouth or hands and since it is not an E cigarette then they can't do anything. If they smell cigarette in the truck then it was because I was out of state earlier. -
I find it interesting (as a British born lad) that different rules apply, in different states.
Age of legal drinking etc. varies in different states.Should it not be a level playing field for all US residents ? -
Drinking age is 21 throughout the country, same as voting age, legal age to drive, etc. But yes, many laws are left to the states, such as this one, as long as they don't violate federal laws or the constitution.

I quit smoking cigs in high school. I thought "fuggh them tobacco corporations" I can't afford 60¢ a pack!
But hey I'm grabbing a handful of coronas and finding me a load to Williston! I like to flout the law.
