Can my company do that?

    you can sub contract drivers...use to have a bunch of drivers on 1099's nothing illegal about it...the goverment does not like it but its still legal to have drivers on 1099 and not W2's...

    i would look at your application and insure that there is nothing about paying for driver errors....if not i would contact the DOLabor, and talk with a lawyer....

    Kinda sounds like they just did to me! No matter what agency you contact, even if they agree with you, will probably result in you having to take them to court. If it's a small-claims court and you get a "judgement" against them saying infact they owe you,,,the burden of collecting is on you.
    That means a lawyer and court case.
    I hope they pay you as they should! Either way,,,quit em!

    OOIDA is great with stuff like this for advise! I'd call them and ask what to do even if your not a member they will advise.

    No you can not sub drivers ..they are only allowed to pay up to 6 to 8 hundred dollars on 1099 or tax free ...after that amount you must be either sub or employee

    Maybe you agreed to pay for any damages when you hired on, including equipment damage. Usually there's a warning before the engine "just blows up". Like overheating/low oil pressure/knocking. Company got the repair bill and said ouch, we need to gig the driver for some of this.

    I contacted the IL Dept of Labor and notified my company that I did so. Now all I can do is wait.

    I did contact IL Dept of Labor. Now I'm waiting to hear back from them. I also notified my company that I did so as well. As usual they are ignoring me.

    I feel bad for the OP, though. Sounds like another fine, upstanding company trying to wring out some bucks from a driver....
