Can my company do that?

Drivers stand in line for these "opportunities" and then when they get the "shaft" they feel violated. There's more than enough warning here about doing a 1099 contractor deal and yet every day there's someone complaining about it.

It's clearly known if you are employed to drive someone elses truck you are an employee and can't be 1099ed. These weasels think they can dodge taxes by doing that. He also can't make you pay for damages unless you signed an agreement before hand like when you hired in. After the fact is coerced and won't hold up.

I would ride it out a little and see what he does. You do have the Dept of Labor on your side and the state of employment is the one you file with. It's easy to file online to get the ball rolling.

How many miles were on the engine? It's hard to blow an engine today with the low fluid engine shutdowns unless you over ride or over tach. Most are from mechanical failure from hydrolocking or worn parts. It doesn't take a few minutes to hook the laptop up and look at the engine history. What were you taching going down the hill? Looking at your experience level I wouldn't think that would be an issue.

Even if you were at fault the most he can do is terminate you and maybe file a civil suit. He can't just rob your paycheck.

 

Why someone would drive a company truck under a 1099 is beyond me. Personally, I wouldn't even turn the key. The owner is obviously shafting the IRS, so don't think the owner wouldn't shaft a driver at any given chance.
