Broker agreement

    I booked a load with a broker after I completed the load the customer called me direct and ask if I would haul a load for them direct. Could the broker come back on me for dealing direct with the customer??

    What does your contract between the broker and you say about "back solicitation"?

    it says no back solicitation for a year

    If a shipper comes to you, it isn't "back - solicitation" - I would go for it in this case. Essentially you didnt go "back" to the shipper they came to you. Perhaps the shipper may be violating the agreement that he signed with the broker however that isnt your problem. I would take the business assuming it is an acceptable rate, lane, etc...

    I usually do the same thing, and did the brokers customer call you or did the brokers customers customer call you, and I'd make sure the load hasn't been double brokered or some other nonsense, if it has I'd tell them to Kiss My ###

    That was my thought i didnt go to the customer. they came to me... They have decent rates but nothing steady.. but who does

    Quite possibly the broker whose customer you stole. Granted you didn't go to the customer, agreed, don't think the broker will care either way, and if he has steady well paying stuff, well....what do you think the chances are he's going to call you again?

    Take the direct freight. The shipper called you, you did not call them. Plain and simple.
