16 Hour Exemption (local drivers)

    Another thing with the 16 hour rule is you've only used it if you go beyond your 14'th hour while on the drive line. If you get back to your yard at 13:45 and spend an hour dropping and fueling for 14:45 total you have not used your 16 hour day because it wasn't on the drive line.

    I used to run into this a lot back in 2009 when I was one of the last drivers on a very long run because I wanted that 16 available for Friday night if I got hung out to dry on the dock. We were using 60 hour logs back then too so I had to run short at least once a week.

    You are correct. It has been a while, sorry about the bad info. "What constitutes the 100-air-mile radius exemption? Guidance: The term “air mile” is internationally defined as a “nautical mile” which is equivalent to 6,076 feet or 1,852 meters. Thus, the 100 air miles are equivalent to 115.08 statute miles or 185.2 kilometers". FMCSA Question 12

    You're dead on accurate.. I had a city peddle for a couple years that was 135 road miles the shortest way to my last stop but was under 100 "air miles" so no log needed unless I worked more than 12 hours which was rare.

    I used to drive for Conway freight out of Sparks, Nv. and they would pull this nonsense with us every week. They always seemed to be shorthanded on the dock in Stockton so they would make us stay longer to finish working the loads. I was told we could use the "exemption" once a week. I tried repeatedly to impress upon them that it was supposed to be used for "unforseen circumstances" NOT as a tool to accomodate their lack of planning.
    Needless to say I chose to leave. They also used to REPEATEDLY try to get my son to pull triples even though he was a) NOT yet 25 years old and b) not certified on them.
    For such a large company you would think they'd be sticklers for regs, but my experience with them was not that at all.

    when did you leave? And by chance did you ever grace the ever so wonderful USA FAC. They treat the reno drivers well there I heard.

    Anybody with experiance with the 16-hour exemption for short haul (100-air mile radius) clarify this for me so I can be secure when I confront my supervisor with this. I work a 12 hour shift, 12.5ish mile one way, and back empty. Most days I am real close to driving a full 11 hours in those 12 hours. My supervisor insists that we can run 16 hours and still maintain our short haul exemption. Points of contentions:

    16 hour exemption extends the 14-hour clock, not the 11-hour clock?

    To use the 16 hour exemption we loose our short haul exemption and have to fill out a log book?

    And here's the big one that still confuses my supervisor, as short haul we still have to adhere to the 11, 14, and 70 hour clocks HOS?

    I still may have to call the FMCSA hotline for total verification but if anyone here can help me out I'd appreciate it.

    I used it once. I was told this was to be used only if returning to your home terminal. I didn't really care, I wasn't going to sleep in a hotel when I'm an hour away from my house.

    The day i work a 16 hour shift it will be because i'm back in the military and that aint happening!

    Yes, it only extends the 14 our clock - not the 11.

    You have to fill out a log after 12 total hours no matter how they break down on the short haul exemption.

    The adverse rule allows you to extend to 13 driving but you can't go over 14 total and the two can't be used together.

    You still have to follow the 11, 14, & 16 rules. It would be hard to go over 11 driving though and stay under 14 on short haul though..

    If you break down when you are on your way back to the terminal it will be kind of hard.
