I got a question for anyone with an answer.
I'm fairly new to trking, 6 months otr/ run 40 states so far, n.e. ded. ded. accts. have run 53'van/reefer/48'flatbeds/and pup trls. Have hauled everything from consumer goods to lumber, steel coils, ects, ects....
I think in 6 months i've pulled more different trlrs and frieght than most new people?
Here's the question/maybe big problem?? On one of my loads i was in a gas station type parking lot ( had to do an emergency tire presure check, in other words had to pee real bad ) while i'm outa the trk force of habit i do a qik walk around and so forth. Get back in trk, get my seatbelt on , get all adjust, all that good stuff. Go ahead get ready to pull out, check traffic all that good stuff, its 3 am in the mornin so not much going on at all. go ahead get back out on the road, check me mirrors make sure no-body sneeking up on me all that good stuff. ( yes there were other tks in this parking lot, some were snoozin, some were doing whatever?) Well to make a short story long, two weeks later i got pulled into the office, and told/asked why i didn't report my incident ?? Now the look on my face had to be that of a dead cow, I said what incident? I haven't had any that i know of, well we have you on videotape, your trlr hit a pole in xxx town, at xxxx place and you didn't report it. Well right off the bat, i came back and said if i hit a pole don't you think i would know about it? and i shure the heck wouldn't knowingly hit anything and not report it, so let me see the vidio tape, and let me see what happen and get the situation under control. They told me NO you don't need to see nothing, you need to get your trk cleaned out, and I ( i meanning DBL ) feel i don't want you driving for me. Now its been a month later, haven't never heard boo from a sole about nuttin, i get a letter from this company telling me after there review they feel it was a preventable accident, and with it i get a letter from xxxxx town with a ticket in it for this crazy!!!! amount for a fine, private property damage, pay inclosed fine!!! ( got letter and fine 31days after being let go) and i still don't know till this day if i indeed hit the pole or not... Now my next question for tha day is, What will happen to my DAC, and now i got a ticket on my cdl will i ever be considered for another driving job with this on there?? I haven't driven in a month cuz i got pretty pissed off at this company, and myself and been just thinkin is it worth it or not?? I'm 46yrs old, drove cdl-b for 5yrs, then went to cdl-a 6 months, this is the first ticket in my whole driving career i have ever, ever gotten, car, trk, motorcycle, even done rollerblading(hard on my oldman ankles though) so i think i've been pretty darn careful, or pretty #### lucky??
So i guess the bottom line is: Will this ruin my cdl driving career as far as getting another ride. Any and all information will be Greatly App:

GET A LAWYER!!! They''ll see the video and if it wasn't you (which you're sure it wasn't), they'll straighten it out and make it all go away. It'll also clear your DAC.

I totally agree, get a lawyer. There are too many issues here to play with. They have accused you of several things and proof is certainly needed. If you are in the "clear", then I would be talking to the lawyer about a nice settlement from this.

and lets say for some reason that i did strike the pole with the rear end of the trlr and didn't catch it in my mirrors, then i guess my lic. is shot??
Pretty sure i'm pleading Not Guilty till they agree to show me the video.
And i say rear of trlr cuz that would have been my only blind spot. -
pa-shocker, if your trailer axles were pulled ahead, its possible that your trailer could have swiped something without you realizing.
However, its NOT fair of the company NOT to show you proof of your incident. Accidents happen to the best of us, but this sounds a little underhand.
