@Maffy95, I dunno man, I had a cop stop me in Banning for speeding and when I told him I had cruise set and I was not going anywhere near the speed he claimed his response was "I didn't shoot the laser the other guy did", I fought it and it was thrown out, not sure on what grounds I had a lawyer take care of it but I got the money I paid for the ticket back before I even got the dismissal letter.....The cop may just have said that to the OP.

The last time I fought a ticket in my car.....many years ago....the cop changed his story twice and finally admitted he could not even see my car when he cited me for a right turn on red, and admitted he had his back to me because he was citing someone else. I had a picture proving the cop could not see me because there was a bush in the way anyway. I still lost.
Cops come into court and give their 5 minute speech about all their training bla bla bla.
Then you get up there and try to fight them.
It never ends well.
I will probably just pay the $60 and forget about it.
If I ever see conditions like that again, I will park it or chain up.
Probably just park it.
Not interested in dying or hurting anyone else over this job.

That's part of the problem with Wyoming is you might not even see the conditions coming like mentioned earlier. Although, during the winter Elk Mountain has blowing snow most nights and Sherman has had blowing snow every single night I've gone through this winter so those are pretty much guaranteed to have trouble spots. When I'm heading west through Elk Mountain I'm always counting down the mile markers to 245. A majority of the time it clears up once you get there.
Just went through heading west this Tuesday night/Wednesday morning and there hadn't been anything on the road surface since Wamsutter. Heading west, there's a pretty short but slightly steep hill after you pass Little America where you drop off a small plateau. Come over the crest and it's a solid sheet of ice in the right lane, no warning. Nice little curve in there too. It's the kind of thing that happens in that state. The constant high winds in that state always create the possibility of something bad. -
No offense to anyone here, but this isnt a case you fight to get the ticket thrown out. Get an attny and get it reduced to a non moving violation! The system is gonna get its money out of you, but you can get it downgraded from a problem to an inconvience.

If you have a way to prove what your speeds were prior to the crash as TruckersPete said it can only help your case in the fact it shows you were attempting to drive with due regard and safely. I would definitely plead your case. One thing to consider with any law when it is written so vaguely such as excessive speed is when it is enforced judges try to consider the "spirit" of the law. When I say spirit I mean within reasonableness.

Heck in El Paso unless someone is injured or the vehicles can't be moved the cops wont even show up. When my wife rear ended a work truck, the cops said she had 15 days to file a report at the nearest police substation if she wanted a report. Neither her nor the guy wanted to bother with that so they exchanged info and left. -
I don't have any evidence other than the fact that there was minimal damage to both trailers. 1 busted marker light.
Oh, I should also mention that the cop did not have me sign the ticket.
He wrote "not required" in the signature box.
I have never seen that before. -
At some point dwelling on it will eat you up and may adversely effect you driving ability... you may second guess every move you make... however plead it out pay your fine THEN turn the page and be the professional you are...
Like I said before it was a tap... I mean come on a marker light... there was no need for a report or citation... I wasn't there but we are getting the story from one perspective... not trying to be arumentative just trying to give the perspective of the other two people involved... the cop and the other driver...al_huryn Thanks this. -
I don't like the idea of it being on my MVR, but I am not the only one with a blemish on their record. If nothing else, it was a MAJOR learning experience and has made me a little better driver.
If you pass a Watkins Shepard truck doing 53 in a 55, that's probably me. lol -
