Okay any and all who can help here is our problem
My husband and i are in a lease purchase with a small time company. We got into this in July of last year. We where making pretty good money doing it. But it seems here lately for the past three to four weeks that we are beginning to get starved out of it. Before for all of this started we where bringing home $1000 to $1500 a week after expenses and lately we have been barely brakeing $700 after all expenses. So here is the question what if anything can we do about this and is it smart for us to begin looking into a lawyer .

I would try to figure out if freight is just slow. It is late winter. Freight commonly slows a bit this time of year. if they are trying to cut you back for some reason, you'd have to see if it is a contract violation before a lawyer could help you. From what I have heard, clearing 700 a week on a lease purchase deal isn't too bad. Many guys in lease purchase deals get to where they are happy to clear anything.

Depending on where you are , where your truck runs and what this SMALL TIME company hauls things can be very slow this time of the year.
Before running off to the LAWYER , ( check things out ) are other trucks with the same outfit running while yours is sitting or is it slow for everyone, has your husband done ANYTHING to maybe get put on the bad side of dispatch.Last edited: Mar 14, 2013

I agree with above posts,this time of year it's slow,between freight and rates if your still able to pay the bills I would probably hold tight bit.

$1000-1500 a week, good money? That's company driver money IMHO.
Freight is slow, or was in January for us at least.
Good luck on trying to sue someone over you not making enough money. If that was the case, then every other business could sue before they went bankrupt. I would be totally amazed if any lawyer took that on myself.
You did the lease, you should have done more homework before the lease, you should have known the freight ups and downs before leasing the truck, and so on.
Sorry to sound harsh, but this is the real world. Companies try to screw (F)lease operators, freight goes up and down, and so on.
I doubt there is anything you can do about it, as even if the other trucks are running, it's far too easy for your dispatch to say "we called them and they turned the load down, so we gave it to another truck". That is trucking, especially as an owner operator/lease operator/whatever.

Freight is slow almost every February. Rates and loads are starting to pick up. People like to hybernate in winter. Remember, there has been lots of snow in areas around the country. Keeps people inside. Hang on like the others have said. Be safe out there drivers.

I doubt there is anything you can do about it, as even if the other trucks are running , when I mentioned on checking things out , it was to get her to look at things before running to a lawyer , not run to a lawyer if the other trucks were working and theres was not.

Just wanted to be sure the OP didnt have those rose tinted lease glasses on before going and dropping a grand to get a lawyer etc.
