Ok thanks I will not do the per diem thing. If I am understanding it right I can get the same 52 dollar dedution on my own and keep the extra 2 cents a mile myself that they are going to take from me for "doing me the favor" of doing the deduction for me.

the plus without per diem is then you can write off your expenses during the year. with per diem you can not. if you do the write off thing you will actually came out better in the long run.

You can't write of anything if you take the stanbdard deduction of 52 dollars.

You can write off expenses either way. The per diem is ONLY for food.

yeah I just realised that. So really there is no point to the company doing this for you. Except they are ripping you off 2 cents a mile.

sorry but wrong. per diem is set up for a drivers daily expense. the company gives you 52 dollars a day and they feel that should cover your food and other expenses. fuel is not included in this.

Read the Pub 463 page 6.

By the way. I am an enrolled agent to practice before the IRS..IE a professional tax preparer since 1982. I am quite sure of what I wrote...:yes2557:

that's fine , whatever. good ahead and argue your point all night long, because you'll be doing it by yourself. go ahead and try to claim per diem and then right off road expenses at the end of the year. while your paying back taxes to the irs, i am sitting in maui drinking an umbrella drink watching the hula girls.

I am only trying to provide correct tax advice. The per diem is listed under Special Meal Allowance for transportation workers.

I have had many audits. I only lost on one. I have prepared thousands of returns. How many have you prepared?

Have you ever had an audit?

There is no reason to be spiteful. This guy is trying to get a good start. If you have not read the law or the page and can't show your support, why try to confuse him?

Best of luck. I do not worry about what I file. I HAVE to file it legal. I can lose my license to prepare returns.

Thanks for all the help. My point is I can take the 52 a day by myself without loosing my 2 cents a mile. I can just save all my other reciepts and deal with that later on when I am not pressured to make this decision.
