Look at the local employment laws. There are restrictions on what an employer can say when answering about prior employees. Each state is different, but it should be on your state employment laws web site. -

2. What dates from/to this person work for your company?
3. Has said person ever failed or refused to take a drug or alcohol test?
4. If presented the chance to do so, would you re-hire this person? -
Eskimo is correct. As an employer myself, the questions he listed are the only ones I can ask, or answer. The key question is would you rehire someone, a negative answer is taken to mean "you shouldn't hire them either". No clarification of this answer can be requested, or given. Unfortunately there are some companies that have a no-rehire policy for any driver. I worked for Pepsico Food Systems and they had this policy.
You should be more concerned about what can be on your DAC report. I had a heck of a time when my last lease company (let's call them Quality Carriers). My DAC report had me listed as working for them for 7 years. I was there 18 months. They had my ending date two years before I actually started with them. That wreaked havoc with my next lease contract as I scrambled to produce paperwork to document my application was "true and correct" and not in any way falsified.
