My fiancee and I are both drivers- this will be kinda long, but I want to include the whole thing so no details are left out. My Fiancee left a job at what we will call Rip and Jip Express about 6 months ago. Mom and Pop outfit- not a major carrier. Rip&Jip did exactly that- they promised him 800.00 a week, which was actually really crappy paychecks of literally 150-350 a week gross- Rip&Jip didnt have the freight they promised. After several discussions with dispatchers and then the gentleman that did the lying and hiring, my fiancee informed him that if this continued he was going to clean his truck out. It did continue, and he did indeed clean his truck out. Parked it at the appropriate terminal, in its proper place, and turned the keys into the shop. The "gentleman" who hired him called him on the phone and quite nastily told him that he better NEVER have someone call him for a job reference because he wasnt getting one he could be proud of. He applied for and got a new job within a few days. He likes his current job, but there are no benefits at all where he works now, so he applied to a major carrier. He was turned down today without explanation after being told they were having trouble getting employment verification from Rip and Jip. They got the verification today, and passed on hiring him. He has 15 years experience and has never had a denial for employment before this, only one speeding ticket (65 in a 55) , no DUI's, no felonies, no accidents, no abandoning equipment, etc etc. What we cant figure out is what the hell Rip & Jip could have told them he did that caused a denial for employment and how can we find out? The major carrier refused to tell him. If we can find out what they are saying, then we have recourse- but how do you battle what you literally dont know? Is there a way to force one end or the other to tell whats being reported?

I would sugest running a DAC report. becouse by LAW they can not tell them anything on the phone except that you was employed by them from this date to that date and if you would hire that person back.....PERIOD......If they say anything else they can be held liable for slander.
If you want to find out if they are telling more then what they are suppose to make-up a fake company name and call them for employment verification and make sure you have a recorder going. -
I'm pretty sure it is illegal to record someone without their knowledge or permission. Check the laws of your State prior to trying that.

It is enough for large carriers to make a decision to hire/not hire a person by the answer to only ONE question: "Would you RE-HIRE"

Person to person calls...perhaps, but "business to business" calls in most states are not illegal. In MANY states, recording a phone conversation is LEGAL as long as ONE PARTY knows they are being recorded. But as always, I am not a lawyer, but I DID stay at a Holiday Express.

Check the laws in the state they are in. Ask the present employer what they said when they tried to verify employment if they bad mouthed him get it in writing has you "may have" a law suit. Some states have strict laws about what can be released over the phone or said about an employee. If they are bad mouthing him it may be considered slander.

How long were you at RipJip? If not long, you could just "forget" to tell your next employer about that job. Of course this won't work if they subscribe to DAC, but then again most M & Ps don't. Leaving out the info would be especially effective if you stay at the present company for a year. This outfit offers no benefits, sure, but you knew that going in, right? Stay with them for a while and then apply at the good outfit. Don't mention R & P unless you MUST for some reason. If you were there only a short time, as in a week or two, I'd not mention it.
When it comes between being honest and getting a paycheck, the paycheck comes out on top. Sometimes when you tell the truth, you get the shaft. -
How about just showing the pay stubs for RIP and Jip? With an explanation of why you would prefer they not be contacted for a reference? At least this way you have proved you worked there.
I would think a prospective employer would look at those pay stubs and understand why your husband left and be more than happy to ignore a bad reference from rip and jip. -
That's a good idea. You could use your Ripper pay stubs. If someone in the good ol' boy circle has a problem with what he hears from Jipp, you can just pull out the pay stub(s) and show him why you left. If it's puny, and your prospective employer still shows you no sympathy, then I'd scat out of there.
