I was referring more to the things I have personally seen around my home base. People trying to turn around on a country road, getting stuck & dropping the trailer & then the trailer landing gear sinking in the mud & the trailer tipping over very slowly, a guy pulling off the side of a 2 lane highway with a soft shoulder after about 2 inches of rain & sliding sideways down the hill. Trust me, I've seen a lot of stupid #### by 4 wheelers, but I've seen more "shake my head" stuff by truckers. I sat at the J in Sioux Falls for a half hour last week waiting for a Central truck to TRY to back into a spot when around the corner there was about 50 pull through spots. Yes, 4 wheelers do a lot of stupid stuff, but if a truck does something stupid, people can die & or roads can get shut down for hours.

Were the dump trucks doing the speed limit? What exactly was your brother cited for? If he exceeded the speed limit to complete the pass, then I'd say he deserved a citation, but I'm no legal expert, just a law abiding citizen.
My understanding of impeding traffic is when a vehicle prevents other vehicles from reaching the maximum speed limit.
I find it utterly ridiculous that any L.E.O. would cite a vehicle that is traveling the posted speed limit in order to make way for vehicles that disregard the law...although, if the speeders can't speed then speeding tickets can't be written.
Why not charge the non-speeders with conspiracy to deprive the state of income?

There were three lanes on the freeway. The two dump trucks, both from the same company, were loaded and driving side by side in the right two lanes, going about 2-3 mph under the speed limit. My brother passed in the leftmost lane (hammer lane) going the speed limit, then pulled back over into the right lane. He was cited for driving a truck in the left lane, which is a clear violation.
He elected to have a Trial By Declaration. We submitted a written statement. Our argument was that the dump truck in the middle lane was in violation of the code I cited above, because he was blocking the flow of traffic for well over a mile (both trucks going the exact same speed). The loaded trucks were kicking off rocks and dirt, and my brother was stuck in the middle lane behind the truck that wasn't completing the pass. He made the pass in the left lane in order to avoid the hazard when there were no cars approaching in the left lane. We showed that according to the law a truck can get into the left most lane to avoid impeding the flow of traffic. The officer was in an unmarked car following my brother's truck and pulled him over. We argued that the officer should have pulled over the dump truck driver in the middle lane instead.
In order to do a TBC he had to pay the fine in advance. We received the results of the trial in the form of a check from the court, with the word "Exonerated" on it. We thought that was pretty cool. -
In that situation, I would have done the same thing and expected the same outcome. I'm glad your brother beat that ticket and rightfully so.
My gripe is with drivers who think I should hurry up and get out of their way so they can exceed the speed limit, then come on the forum whining about how I deserve a ticket because I am preventing them from breaking the law.

See, here's the thing. Who really cares if you are going exactly the speed limit or not? If you're not in the right lane and traffic keeps moving around you and accelerating away you should be in the right lane.
I remember my driving instructor telling us something that I liked and agree with. He said the average person has no idea how many trucks are actually on the road. That's because they don't really notice them. Oh sure, they see them but unless they stand out they're just part of the scenery. This is true off all vehicles actually.
The good driver is rarely noticed he would say. The dude going exactly the speed limit in the middle lane when everyone else is going faster will be noticed. -
Doesn't have anything to do with the speed limit. Has to do with respecting all the other drivers out there

Impeding traffic has nothing to do with what speed you're driving. It deals with the 'keep right except to pass' laws. If you linger in the left lanes for no reason, you're impeding traffic.

Actually I had one get in front of a big truck and slow him down so I could pass him, the truck would speed up each time I went to pass and the 4 wheeler noticed it. I was pretty surprised.

Ridiculous? Really, if traffic doing 65 yet the speed limit 55 and a car or truck doing 55 it causing a very dangerous for ALL. Them selves and the other traffic. That is impeding traffic.
I even heard L.E.O complaining about people slowing down when they pass them while sitting on the side of the road, for other traffic comes alone and has to make fast braking losing control and crashing into them.
