Swift...do i really need to say anything more??

    I would suggest you look into Californias privacy laws and how they pertain to the collection,storage and distribution of a persons personal information.
    Pretty much every state has laws in place that allow people to "withdraw their consent" when it comes to a private company like DAC. If you follow the guidelines set forth by the state and withdraw your consent to collection and disclosure,DAC being a private company will be forced to comply and close out your file.

    DAC is a private company subject to state/federal privacy laws.

    Simply withdraw consent. When drivers begin to do this across the board DAC will be forced to either begin reigning in the unscrupulous companies or arrive at a juncture where enough drivers have withdrawn consent that companies no longer find the service usefull due to incomplete files and stop using DAC altogether.

    Who knows what you signed. If they clearly outlined truck turn in procedures and you acknowledged those procedures then you are not going to get out of this through a loophole. You chose for whatever reason to sneak off like a thief in the night. Seriously bro? You couldn't even be bothered to turn in the keys?

    Try going through the DAC dispute process first before looking for more complicated solutions.

    The Dac resolution process for him (on his own,he needs to involve knowledgeable people) will be a waste of time for one reason.
    He was basically charged with Misconduct by "abandoning his truck". Under Law he is not entitled to the same documents as other employees would be who simply quit and held no company property at the time. From my basic understanding it looks as though he would have to get a labour lawyer involved.

    The easiest thing for ANY DRIVER to do is simply withdraw your consent for DAC to disclose information especially when they allow and I would also guess encourage companies to list "abandonment" as it automatically sets forth the laws of "misconduct" when it comes time for a person to aquire information without involving a lawyer.

    The best option for you is to call them and tell them what happened and what recourse you have,they would help you alot better than I could ever.

    Did you have permission to deadhead to the terminal.? How far was it? Didn't bother to even turn in the keys? I have quit 4 companies in 20 years. Never had a problem. I don't think it is truck abandonment, but you should have done things differently. Now you have a problem that may haunt you for a while. I would definitely try to get that off my record. Some employers will see that, and you won't be considered. Truck abandonment is bad.

    The terminal, my home terminal, was only 50 miles away, and I only chose to deadhead after I was given two seperate loads from the same DC that both fell through in the same day (swift for you). I called after hours dispatch and asked if they'd like me to stay over night and attempt to retrieve atleast one of those loads in the morning. They advised against it. I had no opportunity to turn in my keys, the shop at my home terminal was lock and key. After cleaning my truck top to bottom (which included re wrapping my mattress in plastic), I parked the vehicle in a service designated space and left the keys inside the vehicle. I sent a free form macro which included driver code, truck number and vehicle location with instructions on site at the service center. If any of what I did could be construed as truck abandonment then the very definition is so incredibly loose that it shouldn't hold any weight or validity when considering me for a future position.

    I started with Swift. Made it about 8 months. When I quit I walked in at 7AM, handed my keys to my DM, and walked away with no problems. I honestly think what you did is perfectly fine. In my short time there I went on 6 different truck salvages. The condition of 5 of those was so bad I think they were scrapped for parts.
