    You don't have to allow them, they ask for permission...BUT if you don't allow them in you're fined? Do you actually see what that says? You're compelled to allow them entry, without them having a court order. While I agree so far they still knock and ask to enter, I will again suggest that all it takes is for their leadership to say, they must allow us into the place to inspect so do not wait to be invited in.

    The FCC's regulation that requires us to give up our right to privacy in our homes to use something is government control, period!!! What's so hard to see about that? You do not surrender a right just to use a product. I don't care if this has been happening since Moses parted the waters, it's still not right!! We the people surrendered this right when this regulation was written. The problem being it's a regulation, not a statutory law. Regulations do not need the scrutiny of our law-makers. It bypasses our congress, and undermines the constitution. It's been happening for a long time, and is getting worse.

    Yep, it's simple don't want the FCC inside your house, don't set up a "station", ie; use a 2-way communication device inside. Hey now that's freedom of choice isn't it??? :biggrin_25513: I think Rat has the solution, too bad it won't happen anytime soon. I think I'll quit now, because any further attempt to clarify my position will turn this thread in the wrong direction.

    I got no problem with running power. But if you are making your neighbors mad and getting letters from the FCC. You need to stop! People like this guy is why I don't really care to talk on the radio anymore. Idiot!

    I agree 100% Mike.

    Also Gadfly, I'm not against having those that do like this idiot held accountable. My whole point is that the government should do it with respect to our constitutionally protected rights to privacy. If there is a violation of a regulation or law, then they should be required to petition a court. Unless there are exigent circumstances, like someone's life is in jeopardy, then LEOs must obtain a court order to forcefully enter someone's home. Tell me what is the emergency when it comes to using an illegal radio setup? Nothing!! If the FCC wants to enter and inspect, and they are refused, then they should be required to do as LEOs are. Go get a search warrant. There should not be a fine for just saying no. Someone doing so is just doing as they should, forcing the government entity to do it's job correctly.

    With 24 yrs experience as LEO, one of the functions that I would participate in is known as Drug, Criminal Interdiction. This is nothing more than trying to locate contraband in vehicles traveling the highways. What we hoped for, and surprisingly was granted even by those that knew they had something illegal in their vehicles, was consent to search. Most people think they are required to. Wrong, they are not. I made it clear to all my family and friends, if you're stopped by a LEO and are asked permission to search, say NO. Unless the LEO can see in plain-view something illegal, then he can not just search without a warrant or your consent.

    You may not think this is a big deal, but have that power of a government enforcement entity come after you, and you will wished it had not. The more ignorant you are, and the more they pick up on this, the more they are going to push.

    That's the point I've been making with my replies. In order for society NOT to be subjected to harmful, unwanted interference, somebody, or some agency must be allowed to exercise control of our actions. If we won't take responsibility for ourselves, then SOMEBODY has to. How else can that "somebody" mitigate the problem without the ability to inspect radio stations located on private property? If we did away with the "bad old FCC", then somebody would still have to do the things that FCC does. How could anybody gather evidence with which to prosecute an offender if there was no way get to it? Because of the flexible nature of radio, if FCC could not inspect, by the time they could go thru the process of obtaining a search warrant, the evidence could be hidden or removed. This is why, according to US Code, Title 47, that the rules state that by the terms of your license (and, yes, CB radio IS "licensed" and governed just like all radio by FCC), you have already AGREED to submit to inspection of your CB station by the act of operating such station and have, further, agreed to abide by ALL the rules. No one said you HAVE to operate a radio. But you DO have to operate one responsibly and within a framework of rules that benefit us all.

    The operation of a CB station is NOT a "right". IOW, you do NOT have a "right" to use a device with which to propel your voice for hundreds of miles, nor to create problems for others WITH that device. Your "free speech" rights end with the use of a device that has potential for causing harm---even the loss of life. Therefore, these are the rationales for such rules that constitutional extremists chafe against because "they are coming after 'my' so-called 'rights'--- with the emphasis on "I, me, my and what I want".

    Rules are part of life, and we must have rules for a society to exist. This includes radio. Think of the person this thread is about---the "BIG, and BAD" 'reddio' operator who thinks he's above the law, and thinks only of himself. Multiply that by hundreds, and imagine your radio experience if there were NO FCC, no rules, no regulations. Imagine a world where YOU were trying to get a message to the rescue authorities, but you couldn't because there was a low-life loser with a big mouth and a "big reddio" monopolizing the frequencies.

    Radio is, after all, a vital tool for both military and civilian users. To most users it is an essential link, not a toy, for the amusement of a select few. It HAS to be that way. After CB radio is, mostly, a "toy" except for truckers who rely on it for much information. Outside of that it is an outmoded mode of communications, replaced with cellphones, fax, and email. We're lucky it hasn't been done away with!:biggrin_25519:
