CA idling law??? Tickets? Enforcement??

    You know, with all the EXCESS idling I see going on, I could see them making a law and setting a temperature. If it's under this temp, you can idle for heat. If it's above this temp, you can idle for A/C. That would make a lot more sense.

    I saw people idling their trucks all night at 50 degrees, 60 degrees. Why?????

    And by the way, 80 degrees is HOT!!!!! to me. I can't sleep when it's that hot. I'm not used to it and never will be - it's rarely that warm here. If it's not humid, I can sleep with a fan on but 80 degrees in a truck is NOT pleasant with those tiny windows you can open.

    I hope it works out to be one of those laws that's ignored.

    OK this is what i got from the horse's mouths (CHP & ARB) before dropping off my truck to get a TRI-PAC installed.
    1-2006 and older trucks can use any APU
    2-pets WILL NOT exempt you from the no-idle rule(there is no provision in the regs for pets UNLESS they are considered necessary for the operation of the vehicle-which they are NOT)
    3-the CHP does not intend to aggressively enforce this-however it is up to the officer's discretion
    4-local law enforcement's commercial divisions will have the authority to patrol truckstops and cite violations at any time.
    having learned all this by speaking directly to the agencies involved, i'm leasing a TRI-PAC with no money down from Lease Corp of America.this way i'll be totally compliant and save wear/fuel. just remember that tune from the 60's-70's "i fought the law and the law won". your cute little puppy is NOT gonna save you on this one-they will say "why do you have this animal in the vehicle and why are you subjecting it to these extreme temperatures?" you might get TWO tickets!!

    If all these supposed loopholes were true, do you all think I would be giving myself the headache of fighting it?

    What needs to happen is for truck drivers to stop hangin the fake ones off the truck and GROW A SET!

    It's one thing not to idle the truck when it's 50 or 60 degrees out... and yet another when you're not allowed to idle unless it's below -10. STOP SUPPORTING these COMMUNISTS! If they want groceries, clothing, fuel, coal to run the power plants that keep their homes warm or anything else that a truck brings... LET THEM GET IT THEMSELVES!

    Download the list of places with anti-idle legislation and then REFUSE to go there. It's as simple as that.

    George Washington would crap a giant gold brick in his casket if he saw the state of our country today.

    They need to update the CARB site, Guy's Lady, then maybe they'll start to "get it" that that's the OLD RULES.

    Folks, I tried to find a link to this information but I was not able. I got this information from my dispatcher. I believe things may have changed since January 1, 2008. I found a lot of information stating that having a pet DOES NOT MAKE YOU EXEMPT from the Idle Law. Here is a snippet of the info I found:

    MYTH 2: YOU CAN IDLE ILLEGALLY TO PROTECT A PET.

    Thirteen states have animal cruelty laws that prohibit leaving pets in too-hot or too-cold vehicles, and all states have more general animal protection laws that ban abuse.

    Additionally, dozens of cities, counties or states have anti-idling laws, with fines as high as $25,000. But you can’t break no-idle laws to keep your pet safe.

    “One law would not supersede the other,” says Belinda Mager of the U.S. Humane Society. “You would have to comply with both laws.”

    Enforcement of a penalty might come down to whether a judge is more pro-animal or more anti-idling, speculates Dr. Richard Crawford of the Animal Welfare Information Center. But there is no reason to expect mercy. While animal cruelty laws can be stringent — New York levies a maximum $1,000 fine — the smart owner-operator won’t risk breaking either law.

    So I guess we are all going to be be a whole lot of melted truckers this summer!

    I know that Brenda! And I wish they would update the freakin site! I would upload all the ppw I have in front of me for this... but there are like 500 pages!!

    I am beginning to think they won't update that site, just because it is causing this much confusion. And if they can keep us confused, then you won't see the driver's uprising that would come if everyone was enlightened on things.

    What about a sticky on almost every page "NEWEST CARB LAWS ABOUT IDLING IN CALIFORNIA"?? LOL...

    Of course they won't update the site... then they'd really be hassled... can't have that now, can we? (sarcasm intended) :biggrin_25521:

    This way, they don't get so many complaints. They're probably hoping to "sneak it in" sometime in the future.
