Driving over your 14 after a breakdown.

    The person stating you can not claim sleeper while the truck is being worked on is wrong. The time on the work order only show the time the shop was working on it, not if you were sleepong in or what time you picked up the paperwork,

    Here is what I found and if you can get the 8 hours without doing any ON DUTY activity such as paperwork signing and such you would be correct.


    Question 25: May sleeper berth time and off-duty periods be combined to meet the 8-hour off-duty requirement?
    Guidance: Yes, as long as the 8-hour period is consecutive and not broken by on-duty or driving activities

    The only time you can get an extra 2hrs is for bad weather conditions you run into. You can only use this if weather conditions on your route were unknown at the time of dispatch. As far as allowed 2 hrs after 14 to find d a safe place no such thing . Its been awhile since I had a hazmat but the whole safe haven thing is about secure parking for hazmat loads if I'm not mistaken.

    I'd have to go back and look at my log... but I was well over the 14 and just over the 16. In 15 years, this is a first.

    Hmm, are you sure that is in reference to the split rule? Because the regs state quite specifically that the 8 hour break must be continuous sleeper and the guidance seems to be saying it can be either sleeper or off duty. Here's the regs that pertain to the split as found in the FMCSR:

    Ya, I see what the guidance says, but is in DIRECT and OBVIOUS conflict with what the regs state.... *shrug*
