HOS question....16-Hour Driving Window???

Actually it's five days. A reading of the actual language is helpful:


(o) Property-carrying driver. A property-carrying driver is exempt from the requirements of § 395.3(a)(2) if: (1) The driver has returned to the driver's normal work reporting location and the carrier released the driver from duty at that location for the previous five duty tours the driver has worked;(2) The driver has returned to the normal work reporting location and the carrier releases the driver from duty within 16 hours after coming on duty following 10 consecutive hours off duty; and(3) The driver has not taken this exemption within the previous 6 consecutive days, except when the driver has begun a new 7- or 8-consecutive day period with the beginning of any off-duty period of 34 or more consecutive hours as allowed by § 395.3(c).

It's actually not 16 hrs drive time. It's an extra 2 hrs drive time which would allow you a total of 16 hours total on duty time for that day instead of the typical 14..provided you meet the criteria to be able to do it as powder joints pointed out.

 

You gain NO extra drive time. You gain more time with which to use your 11 hours drive time.

 

Agricultural exemption, mainly due to the perishable nature of their "freight".

It's not vague. The 16 hr exemption extends the 14 hour window by 2 hours. It does NOT give a person any more driving time in that window. You still only get 11 hours.

 

I am eligable for the 16 hour day where I work. Sounds great, not always fun. Any tine over 14 uses your exemption for the week. So if dispatch is pushing for a long day toward the end of the week, I'll.go 15 min over one day. Sorry, used my 16 already.

Florida has intrastate rules that are different than federal hours of service. They have a 16 hour driving window, where you can drive 12 hours, and have an 80 hour 8 day clock. It's different than the 16 hour exemption for the feds, and you cannot have left the state driving for the previous 7 days (it may be different with your company - check with them. My company used to just check the previous 7 days, instead of waiting and trying to check the 7 days after you went Florida HOS, which I can imagine is a big PITA).

This only applies to loads that do not leave Florida, of course.

 

Intrastate HOS regs cannot lax federal regs. Even if you never leave the state, you are NOT exempt from federal HOS.
