After a crash, should police be able to look through your cell phone history to check if you were talking/texting?

This was a question posted on a trucking website. I answered no. A good buddy of mine who was recently hired on by a local police dept. agrees and says police should not be doing it. If the crash is bad enough then the district attorney can subpoena the phone records. Police officers should not be going thru a citizens phone.

Reread the post and tell me if you see in there that I was planning on texting or on the internet while driving. And then get in the habit of thinking before you type.

Not positive... but it's probably something along the lines of implied consent... I think.

They are allowed to ask for your phone if they pull you over too, I saw something about that not too long ago.
If you can prove its all hands free or voice activated then you can get away, I know I can text with voice but I normally leave my phone out of sight when i drive. I see truckers all the time messing with their phone and not watching the road...so I do agree they should be allowed to see your phone especially in a crash.

like everything else that we have laws over
if people weren't doing stupid stuff
there would be no reason for another law

exactly, truckers gripe about changes and laws but it was from truckers causing the issues.

With any incident they will have probable cause and can look at it. If you are doing the right thing, this is something you will not have to worry about.

Did you fall and bump your head..?...Laws= BIG MONEY FOR BIG BROTHER.The ''safety'' of a trucker and the motoring public is tossed around to make it ''appear'' that big brothers intent is clean and good..

When the real intent is to make HUGE MONEY off dumbed down drivers swallowing this B/S.Just like this half hour break..ROLMFAO...That sure is going to keep everyone ''safe''...To funny..But like many drivers, they drink alot of the kool-aid that is shoved down there throats..

No, I don't think it's a good idea... I would hate for the officer to find the pictures of his naked wife.
