Over Time Pay For Local Drivers ?

    Interstate transportation companies are exempt from having to pay overtime. I work for an interstate company that does pay overtime, however, they are not required to. The law you are referring to dates back 100 years or so. I read it once. The feds exempted all interstate commerce, trucking and railroad, from having to pay overtime. The railroad got their portion overturned almost right away. The trucking portion stayed.

    Call your state and explain the situation then ask them if it is legal. There may be something about it on a state level that can be done.

    Federal law supersedes state law. But there is something to be done ............... kick the jerks in the ##### that ruined it for everyone.

    I think in certain situations you are correct but it depends on what side of the coin things are on. In Washington State local drivers are required to receive OT but it depends on the circumstances. There is also another state that I do not Remember which has the same law. Maybe WI or MI.

    rocky - you are correct. The Federal law is for INTERSTATE (multiple - state to state) transportation. If there is only local in state transportation then that states laws would apply.

    Yes true but the state has a say in it in California. The DoL would be the ones to contact on the federal level.

    Then I guess it pays to work for a Union company doesn't it? Funny, I never see any Union drivers complain. I think that speaks volumes don't you?

    Not all companies that pay OT are union. The better ones do so by choice because they know it's one way to keep veteran drivers. I've been with the same employer for 13 years, and they are union. Like you noted, I have no complaints. For the small price you pay in union dues, it's well worth it if you have a good union.

    Yep they can do that trucking is exempt I'd look for a new job I get paid ot after 40 if they took that away I'd be gone quick!

    I agree. I have a few friends that work for companies like that. Airgas and JCI in the LA area. I have never seen a bad report on them but as usual, they are not an OTR company. I think I see a trend here.
