You're in violation. You're not in compliance. Nothing you can do.

Why would you do that? You knew when you went off duty and when you could go back on, right? If you just went back on duty you would not be in violation but would have to start your ten hour break over before driving again. If you actually started driving and it logged driving then yes you were in violation and the e-log recorded it and probably started flashing at you.

I am assuming you are on e-logs as this would not be an issue with paper logs.

you are in violation for as long as you drive until you complete a dot-qualifying break. So yes, it could be the whole day (an egregious violation if you drove more than 3 hours).

I don't understand how that could happen. From what I hear elogs will scream at you if you try to leave before legal. On paper you just fix it.

But yes, you would be in violation until you took a qualifying break. Depending on the situation you may be able to turn it into an 8/2 split.

If an eLog "screams at you", it's already too late and the damage is done. I think what the OP is asking is what then is he supposed to do? Stop and do his 10 hour break all over again? (the full 10 this time) Who is actually going to do that? I'd just say put the cuffs on me, fine me, fire me, whatever ... I made a mistake, I was running on my phone clock and it changed and I forgot to make allowances, so hurry and fire me or get over it.

crap happens, Ive been run off from the parking area of VA scales by law enforcement in the early morning hours an hour before my break was up (on paper), what was I supposed to do?

This /|\ that's what I would do. I don't completely understand the calculation of it but the qualcomm does and helps me to utilize it when necessary.
