I know of at least a few large carriers that don't allow the usage of the 8/2 split, regardless of the situation (why? I'm not entirely certain. Maybe it confuses their software or their internal auditors?). Although I suppose if such an event occurred that would be their fall back position.

when i used elog with my last company it would ding and go off letting you know as soon as it realized you were moving letting you know you didn't finish your reset before it actually logged you as driving (think its like a mile before it actually starts to log your movement). whether it was just then or the whole day would it really matter?... you got a violation.

You are not always in violation. I once took off 10 minutes too early. After about 4 hrs, the orange light started flashing, telling me I had an HOS violation. I was confused, so I called the log department. It had something to do with split sleeper birth. I took a 2 hr break, and was allowed to drive the rest of my hrs. Don't ask me any more, I still don't understand split sleeper birth.

The split sleeper berth use to be so easy. I went from Colorado to Boston Ma 2 hrs drive 2 hr sleeping (sick and worn out) But those were the better days of trucking. Not the best but better than now.

Split berth is easy, you drive for say 7 hours then do a pti. After 8 hours in the sb you would get 4 hours drive time back and how ever many hours that were not used on your 14. Then before the drive time/14 hour on duty time expires take 2 hours in off duty status and the remaining balance of hours are added back. In the situation I just layed out you would get 7 hours back after the 2hr break

Assuming you got at least 8 hours in the sleeper berth before you moved, yes, you could just stop for another 2 hours and finish the split. However you would still have a violation on your log book (unless you "fix" it.) If you didn't get at least 8 hours consecutive sleeper time during your first break then you would have to stop for 8 straight hours in the sleeper to finish the split break. If your company won't allow you to use it then you will have to do a straight 10 break. The most legal thing to do in this situation is stop and take the break you need to. If you continue to drive and DOT catches you not only is it a violation and possible citation, but most likely an OOS as well. If you take the break the most then can nick you for is a non-oos 11 or 14 hour violation, and very little chance of a citation on that.
