Your employer was in violation for not referring you to an SAP (on page 10)
IMO , if that employer failed to give you a list of SAP's and you can't be hired because you failed to take a required program because you weren't told it was necessary you could sue that employer for your loss of income. First step is to report that employer to the FMCSA and have them investigate how that employer handled other drivers with positive results.SinSityCowboy Thanks this. -

You are asking for lawyer stuff, I only know Trucker stuff.

Now it could be as simple as finding a SAP yourself and having a couple of clean tests. I would still report the company before requesting DAC changes. Using their failure to comply as a reason to remove the DAC would tip them off you know they weren't compliant. Reporting them and having them noncompliant will help your case. -

And also, it doesn't show up on my DAC that I was terminated for drug use, it only states, company policy violation. Does that mean it was also a DOT violation or just specifically a company violation?
