Carrier demands.....

    It's is entirely possible the carrier is taking those expense deductions, too. But that's between him and the IRS, but bottom line ... his name/number on the side of the truck, he has to be able to prove safe operation of vehicles in the event of an accident or CMV audit. Unless you want crash victim attorneys coming after you and hassling you following an accident where "your" truck was involved wanting records, proof of proper documentation and reporting, proof of operating in accordance with dozens of rules and requirements.

    I meant is, it is theres, so you need to give them what they want. They made up the lease so I am sure they can and will do what they want with there truck. So if you dont give them the records, look to work some place else.

    It's part of the federal regulations pertaining to trucking. The law requires the carrier (that would be the folks with the authority) to maintain maintenance records. There would be a clause in the operators contract with the carrier requiring them to release all records pertaining to the maintenance of the tractor to the carrier. Now that would be there regardless of how one is connected to the equipment. You don't make nice with the provisions of your contract, you can take your marbles home... if you happen to own them.

    When I consulted with both OOIDA and NASTC, they gave me a checklist of records and docs I needed to maintain as a Motor Carrier, even if I only ran my own truck... prominently shown on both of those checklists is the requirement to maintain mx records on ALL vehicles leased to the M/C... when you go to the FMCSA's website, they go through a pretty thorough list of things that the auditor will be looking for on the New Entrant's Audit... mx records are on that list....

    That's about as official as I need.

    I lease my truck to an individual, everything he buys or has done to it no matter who pays for it, I have to have a copy of the receipt. This is not for a tax write off, but for record keeping. There are things that I will have him pay for up front if I am on the road and I have a check sent to him for it but he has to send me a receipt before I issue the check.

    I would look at the L/P contract and I would think it would be in there that you find out what the leaser needs to send in .

    i submit monthly reports.

    i have yet to be asked for my receipts. but most of the repairs so far have been minor that i've fixed myself. next time i'll pay a shop to do the starter though. i'm getting too old to lift them 1/2 ton dudes.
