You are not allowed to be under the influence of that one either when operating a CMV, and if you get pulled over in your 4 wheeler, .04 is all you get. I have heard that before and have even seen it in an advertisement for a lawyer but can not see a law where it says that since I have a CDL I am bound by the same laws while in my car. It just doesn't make sense that you can pick and choose the laws that apply to a personal vehicle. Since the BAC is .04 then all the other laws should apply also. you would think. So when you go on vacation you need to only drive the hours allowed, show your past driving history, the inspection of the vehicle and so on. I guess I'm just not a believer unless you show me the written law. Looks like even the FMCSA website isn't clear. You can't be under the influence of alcohol at all, they mention the .04 in a CMV, but they also mention the .04 without specifying. I did find that some states, including Nevada have it as .04 across the board for CDL holders . . . may be a state by state thing . . . states are allowed to have tougher laws, just not looser ones . . .
