Missing your exit is a mistake. Driving while drunk is a conscious decision, especially if you know that your lively hood depends on your liscence. Driving on a suspend liscence is a conscious decision as well.brsims, Marksteven, Joetro and 1 other person Thank this. -
Remember that like others have said, these are HUGE money makers for the state and lawyers involved. That said they will do almost anything to keep the case from trial. You need a lawyer that specializes in this to find any outs in your case, or can negotiate an alternate sentence. Chances are your screwed, but this is your best bet. Do not drive after your conviction. YOU WILL END UP IN JAIL. I was young and dumb once and thought I wouldn't get caught... Well, 15 years later its hopefully behind me.
Here are the important steps to a DWI:
1. get a lawyer
2. remember the incident IN DETAIL! and give as much info to the lawyer as possible
3. Delay if it will let you keep your license
4. go to court
5. accept any sentence and follow it to the "T"
6. Once your done, BE SURE you do EVERYTHING that needs to be done to get your license back before driving!!!
I say this because I did al of the above accept #6. I thought I was good to go after my 6month "suspension". Well as it turns out the judge said 6 month suspension but meant revocation. I got caught driving without a license after my 6 months was up. The cops don't know the details of your case, just know you got a DWI and don't have a license... I slept on a concrete "bed" and ate cold mcdonalds in the morning. The judge let the charges stand because I didn't fulfill my sentence. Ended up retaking my permit test (after another 6 month wait), 5 hr safety course, and then road test 6 months later. (NY required a waiting period after getting my permit) The whole process was humiliating as a 22 yr old adult.
I'm saying all this not to encourage you but to hopefully dissuade you from not dealing with it properly. -

To answer your original questions: No, working on a 1099 has no effect on this situation.
As everyone else said, hire an attorney - yes spending the money sucks, we all get it. In this situation if you think about it, is definitely a time in life where you bite the bullet and hire a lawyer. More than likely if there were no injuries, you can at minimum get it reduced from DUI to Reckless Driving or perhaps some other option that the prosecutor and your attorney can come up with.
Check on the SAFER system and see when your companies insurance renews - if your carrier doesn't pull an MVR on you annually then the insurance company will when they go to quote the renewal. Perhaps you have a few months or up to 11 or 12 months till this takes place. Keep in mind while some may get away with it for a while, what would be your plan if you are to get an inspection and the LEO runs your Driver License and it comes back suspended. More than likely you will end up in jail who knows how many states away from your home base or family members who could bail you out. The truck, trailer, and cargo would probably be impounded and cost your company a few thousand to get out of the tow yard and delivered, etc...
