    The IRS will not have the power to charge you criminally or seize your assets if you refuse to pay. The IRS will only have the ability to sue you. And the most the IRS can collect from you if it wins the suit is 2X the amount you owe. So if you want to thumb your nose at the penalty-tax, the IRS won't be able to do as much to you as they could if you refused to pay, say, income tax.

    Actually, the penalties accumulate and there's interest charged on them. If you're self-employed and you don't have other insurance that meets the federally-mandated minimums, you could get hit with an additional penalty for underestimating your taxes. If you overpay your taxes, the penalties come out of any refund due you. Plus, without health insurance you're risking the big bankruptcy enchilada. The number one cause of bankruptcy in the US is uninsured medical costs. Thus the $95 penalty you avoided sets you up for that big whammy.

    Yes, i am against the tax too, but do you REALLY want the IRS to scrutinize you any extra? Plus you are forgetting that when they sue you they can tack on legal fees, interest, penalties, collection fees, madeupword fees, extramadeupword fees.... They ARE still the IRS after all.

    We all have to make decisions in this life.Every decision has a consequence..I,like many millions of American Workers have made the decision to go with the Penalty...

    Worst case is net under 9,000 bucks and be EXEMPT...

    I think that within the next year, once ppl (everyone, not just truckers & O/O's) see just how much their "affordable" health insurance is going to cost them, you will be a part of millions that either refuse buying into their program, or can't afford to buy into their program.
    It is a disaster already, and the worst is yet to come.

    I'll chime in here then I'm sure this will go to the political section. But the only way anyone is paying this penalty is if they get a tax return equal or greater to that amount. That is it. They cannot go into your bank account and just take it, lol.

    In other words, adjust your earnings so you just about break even, or even owe a small amount to the IRS, and you will not pay the penalty.

    SCOTUS already addressed the IRS's ability to use 6321 (f) to penalize non payment of ACA penalties.

    The only method of seizure that the IRS has is keeping your refund. They CAN NOT use 6321 or 6331 to seize, lean, levy, or demand any property.

    John Roberts made it pretty clear in his "implied"< (very important "IMPLIED" ASSENT) that IRS can collect the money that we are supposed to use to purchase a product from a private business. IRS CAN NOT compel us to purchase private insurance. Thats why it is "implied" assent. Roberts assumes that if we are supposed to volunteer but do not, then the only course of collection they have is to keep your return then you are required to go to court to demand that money be returned (good luck with that).

    Bottom line, those old Gestapo tactics that IRS has always used to scare us into complying have already been eliminated from this issue. If you file taxes in a way that requires you to pay a small amount at the end of the year, they will not be able to collect from you. FYI. Any amount that they say you owe will be on a collection list for seven years so seven years after the last time you do not buy insurance, they will be able to take your refund.

    This "tax" is unconstitutional. According to the constitution ALL tax bills must first originate in the House. Obamacare originated in the Senate. At the time this was put into the constitution U.S. Senators were appointed to their seats by their respective state's governor instead of elected there by the people. A wreckless, ill thought out constitutional amendment changed that in 1913 and since then they are now elected by the people to 6 year terms. Our forefathers felt that all tax bills should originate in the U.S. House since those reps were directly elected by the people every 2 years.

    Which brings us to the constitutional crisis the supreme court inadvertently created when they ruled this was a tax. Since it originated in the Senate it cannot legally be a tax. What does that mean? I don't know. I do know there's only one or two amendments in the bill of rights that aren't violated as a matter of routine. They are ignored and not respected so why should anyone care about an arcane stipulation that this "tax bill" wrongfully originated in the Senate?

    So when the time comes I will refuse to pay it and suffer the consequences. It's good to know there are lots of others who also intend to refuse to comply with this nonsense. Just goes to show how illegitimate they have become. I suppose one day folks like me will get rounded up and tossed into jail for having such "un-american" dissenting political thoughts, what do you think about that?

    Having insurance (on yourself and family) just made good sense, always has. "If you can't afford insurance, you can't afford not to have it" is what my Dad said. I've had my own the last 5 years, but it has risen drastically the last 2 years. And with where premiums, deductibles, and co-pays have escalated to lately, the wisdom of having health insurance is coming into question on a cost to benefit basis.

    But now, this attempt to get more people to purchase more insurance has pushed rates and deductibles to a point it is truly UNaffordable for many and is putting many in a VERY DIFFICULT position as is mentioned in this thread. Government intervention strikes again, and the consumer, business owner, and worker loses in more ways then one.

    This is political matter but it is mostly a business and personal matter driven by political events and that is a real shame this is where we have voted ourselves to.

    I'm just scared to find out what the next thing is they determine all Americans should purchase, lol. I'm thinking life insurance will mandatory next, that way nobody leaves unpaid debt when they die!
