Should be a simple matter for the prosecution to subpoena phone usage records from the service provider that will show exactly what was being done with the phone just prior to the time of the stop. Now if we could get them to move their ticket writing activity to a parking lot or on-ramp away from fast moving traffic, we'd really see some safety benefits.

Nothing. They will look the other way and claim that they are superior drivers. That is the same argument they make when you question their superiors about a hand held cellphone they using when driving down the road. I see it here in WA all the time. The Tacoma police officers that live on the Kitsap Peninsula drive and speed in the HOV lane with their cell phone glued to their heads every day and State patrol does not do a thing about it.

I know up here they've taken advantage of these laws and were handing out tickets randomly without evidence :biggrin_25512: Half the City of OTTAWA COPS must be blind as they do not seem to see the true cellphone users / texters at every intersection in that city.

I am strongly against texting and driving and feel it should deserve the same penalty as DWI but what gets me even worse is the number of cops I see driving around here with the cell phone glued to there big fat round head oblivious to the world. The cell phone law should pertain to EVERYONE. It has the same effect on you whether your a civilian in your car or a police officer in there cruiser which I believe is worse in some cases.

I was just driving my car home from the grocery store, and a kid in a Mustang ahead of me crossed the centerline and narrowly missed an oncoming car.....I could see him drifting over, so I slowed down preparing for a collision in front of me. I am sure he was texting, so I followed him into a gas station and sure enough he sat there texting. It was raining so I didn't get out and go knock on his window and "make sure he was ok". He was probably texting that he almost got hit by a car...

Will the cops have an on board computer and be on it all the time and then cause a wreck?
