Beware : Bad Brokers

    We booked a load from them, hauled it and delivered it 2,650.00. We have invoiced them now since 02/18/2013. They have cut their phone service and FAX service. I looked them up on the internet and they are advertising and new numbers but even the phone number they show is out of service. They gave an e-mail address and I responded to it with no success either. A collections company called transport solutions is after them for many of their clients also. I would be cautious of this broker/ trucking company and I can prove all that I am saying for I have the invoice in my hands now. I am new to this board and hope this does not violate any of the policies here. If so please forgive my ignorance.

    Thats why brokers are required to have a $50k bond so you can get paid and that is soon to increase to $75k in January 2014. Better put your claim in before their bond money runs out

    I hauled for them for $1200 back a year ago and still have yet to be paid. I did file a bond on them so much for that.

    file against their bond and look into reporting them to CoreLogic or some other credit reporting company that trucking companies use. If you don't then your likely to never get anything and your enabling them to continue and they will keep doing. Did you scratch out the "infamous" line in the contract about not being able to seek payment from their shipper? Shame on you if you didn't but if you did, then call their customer and tell them that the broker they use isn't paying and you need payment or they'll be added to the lawsuit you are going to file. This is stuff we all need to do when brokers don't pay. This is how you hurt them.

    I found out the hard way that
    1. You can't file on intrastate loads
    2. Even if you are the first carrier to file on the bond, many holding bonding co's hold the pay to the carrier until 3 months goes by and then they pay the oldes LOADS first, NOT the first carriers to file. That really sucks.
    3. If you have a good co. like TRM go after your money (going after shippers, consignees and filing liens etc.) it still will do no good to file liens if the jobsite was a government contract job. Can't file liens on them.

    Main thing is, like the others said, check them out well first (I like Mark Fresh at Corelogic), or ITS or there is a program with NASTC, but then do strike out the portions of the contracts that say you can't go after their shippers or customers (if they don't pay) and have them send it back to you with the corrections made in the contract before you haul their loads.
