FMCSA. An accident report is all that's needed.
-
Close, the accident has to be checked off as federal reportable.
My experience is about one in five make it thru to the FMCSA.
A motor carrier needs to have the PD report for every accident they deem recordable and included in the accident register they keep.
The compliance auditor uses the reports to determine which were really at fault and then calculates the frequency per million miles based on that number.
I often show 5 - 6 when the SMS has 1 or 2; it all depends on the person completing the report.
I had one removed reciently, a wild turkey flew into the tractor's windshields and the PD had it towed from the roadway. It showed up as reportable and I had to Data Q to get it removed. -
It was a reportable accident, the auto was towed. I was continuing with that premise and that a inspection wasn't required.
Meltom Thanks this. -
Well, without a doubt lesson learned here... filed a request with Data-Q and submitted all facts of the event along with PSP report for corrections. From now on I'll be checking these things not just once or twice a year, but anytime there is an event where law enforcement is involved. Thanks for all the input, Drivers...

Some companies have a policy that determines a blowout which results in damage to other vehicles, property, or injures anyone as an accident(basically it is an accident).
-
From my understanding, the inspections are only required to get citations (including warnings) into the CSA database. Accidents like this are different, as others have mentioned. If you had received a citation it might not have appeared since no inspection was done, but don't quote me on that since a report must have been filed. I wasn't aware that the CSA recorded fault either, since that has been a major complaint many carriers have had since it's inception.

Ok am i the only one that took a doubletake when i red ss recaps ......whoaaa
-
Doesn't record fault. Some think that a DOT recordable means at fault.
-
- My PSP record shows that I was involved in a crash. That crash was not my fault. Why is the crash listed?
Answer
PSP records list all reportable crashes. The list of crashes represents a drivers crash involvement only, without any determination as to responsibility.
- What are FMCSA-reportable crashes?
Answer
All FMCSA-reportable crashes, without any determination as to responsibility, are included in the PSP report. A crash is reported to FMCSA if it involves the following:
AND
That vehicle is involved in a crash while operating on a roadway customarily open to the public, which results in any of the following:- Any truck having a gross vehicle weight rating (GVWR) of more than 10,000 pounds or a gross combination weight rating (GCWR) over 10,000 pounds used on public highways; OR
- Any motor vehicle designed to transport more than eight people, including the driver; OR
- Any vehicle displaying a hazardous materials placard (regardless of weight). A vehicle discovered to be transporting hazardous materials without a required placard should also be included.
- A fatality: any person(s) killed in or outside of any vehicle (truck, bus, car, etc.) involved in the crash or who dies within 30 days of the crash as a result of an injury sustained in the crash; OR
- An injury: any person(s) injured as a result of the crash who immediately receives medical treatment away from the crash scene; OR
- A tow away: any motor vehicle (truck, bus, car, etc.) disabled as a result of the crash and transported away from the scene by a tow truck or other vehicle.
- How does information get into PSP? Is it only from MCMIS or will city police departments, county safety offices, and other enforcement agencies be able to add crash and inspection information?
Answer
PSP only contains MCMIS inspection and crash information that is uploaded to MCMIS by FMCSA federal staff and state partners.
wichris Thanks this. - My PSP record shows that I was involved in a crash. That crash was not my fault. Why is the crash listed?
