I just spoke with a Calif. Highway Patrol Officer about enforcement of Carb.
Here is their plan of enforcement;
Brokers will be required to get written certification from the carrier of carb compliance, before the load can be booked.
The state is simply making everyone in the trucking business enforce this law.
This wont cost the state a dime, but the brokers will do the paper work for them.
Of course there will be large fines if the brokers don't enforce this.
A valid question would be;
How can a state force a company that is not affiliated with, or located within its boundary, to enforce its laws?
This is known as regulating interstate commerce, which only the Federal govt has the authority to do.
We can conclude that the Feds want this to happen or they would sue to stop this over reaching of California to do what only they have authority to regulate.

Having been a resident of this state for 49 years I can tell you calif dont care about federal laws,unless theres one they can nail you on..

Unless the broker is based in the state of California, I don't see them having much luck enforcing any of that.
And if brokers even went that far, they would surely add that extra cost to the shipping quote. Brokers might jump at a chance to charge grossly inflated rates to the freight customer to cover the costs of enforcing CARB rules out of state. Come to think of it, this might be a benefit. If it costs more to ship to California, those sunbaked hippies might finally see the prices of all their stuff go up.areelius Thanks this. -

I've had to fill a couple forms out saying I was CARB legal which I am. I don't see how the broker could know in reality whether you had a CARB compliant tractor and reefer or not.
