Have him arrested. Make it so he can not get another driving job. I do not want him parked next to me at truck stop.

    Lucar and Cetane+ Thank this.

If you have good evidence, get the police involved then fire him.

If you want to give the guy the benefit of a doubt, have a mechanic hook up to the truck computer. Find out the mpg and clear the computer. Send him on another trip and check the computer again when he returns. I had one driver whom was getting 3-4 mpg on a truck that has consistently gotten over 6 mpg for the life of the truck. I cleared the computer and he went to Chicago on a trip. He got the truck up to 84 mph and still got over 7 mpg. He knew that I was on to him and that is probably the reason he was driving so fast, to lower the mpg. If you check the truck and then send him on another trip and check the computer again and the fuel mileage doesn't match his fuel purchases, then you know for certain that he is stealing your fuel. I believe in giving people the benefit of a doubt, but when your fuel mileage suddenly is half of what it has been getting, then you know something is wrong. Prosecuting him will also send a strong message to any other drivers you may have working for you.

not sure if that qualifies as proof but id let him go one way or another
if he can only get 3.2 check statements and see if truckstop has cameras and if u can look at who is getting the fuel

I have trackers in my trucks. I had a couple of drivers steal fuel. I am in illinois. I had a cop present and booted them out of the truck and held their pay to cover the fuel costs.
That is part of the contract they signed with me. That takes alot of brass to steal fuel. At the same token it takes alot of brass to buy stolen fuel too! Pathetic!
My advice to you is sign a contract with your drivers you hire. With this guy that you have right now just lay him off temporarily and never call him back.
I myself would not pay him either. Trust me there is nothing he can do to you at least within the law. Very sad my friend been there done that.

    Lucar Thanks this.

If you just let him go and someone in the future calls for a reference, all you can do is tell them if you would hire them back or not. Legally you can not tell the person that you fired him for theft, esp if it is not prosecuted.

I had an employee years ago who was caught on a polygraph stealing food and eating it without paying for it at a convenience store. He was fired by our supervisor. He filed for unemployment and got it. MS is an at will state also.

I would make a graph too of his runs and the amount charged for fuel vs the prospected fuel usage and see what it looks like.

Also it wouldn't hurt to check into the double billing, etc, just in case.
