Sounds like your your axle flying down the road would be more like a "loose or excess dunnage" ticket. Which would have been priceier. Dot gave no tickets, thats good. SOUNDS LIKE a dump Ga cop wanting to charge you with the only thing he knew. You probably could fight it,I'd probably just pay it and move on. You know about 80% of the cops ,judges, prosecutors are related in Ga or friends since high school.
-
That still doesn't explain how your axle fell off. Axles just don't separate from the trailer every day. There isn't much that someone doing an annual inspection would look at that you shouldn't look at on a pre trip.
-
My 2 cents. If indeed you did a pre trip on the trailer, saw nothing wrong, (I'm having trouble with that) The ticket is wrong, & will be thrown out. I'm glad I was not behind you on my motorcycle.
Big Don, CondoCruiser and NavigatorWife Thank this. -
so your telling me to go under the trailer look at the welding where it welded to the trailer. you couldnt have seen what he was talking about unless you was under the trailer. and if DOT stated that there was no way for me to have known doing an inspection. so thats good enough for me. so unless your a mechanic and certified you must do a heck of a pre trip js

I agree it can be dismissed, but as he said he was hit on by 2 LEOs City Cop and a DOT. DOT sited the company the City Cop cited him. Which I say was double jeopardy but that my opinion. I had once had a State Trooper came along and defend me against a County mounty once to a point but did not look for other violations. But to have 2 different agency writing tickets on the same thing is wrong.
-
You speak of the DOT as if they are some kind of angelic entity. They're just another bunch of bozos that are able to enforce rules placed on us. We are just going on the information you have provided, which isn't much. To tell us that the axel just fell off, is a little vague.
-
so, what your saying, is that the outside tires came off. and not the axle itself. or am i reading that wrong?
-
i wasnt cited by DOT but by a city policemen. DOT cited the comp. he encouraged me to go to court and get it dismissed. i wanted to know how Ga law was written for me to even receive that ticket.
-
Defective equipment is coming to mind. Didn't loose your car keys, an axel is a major thing. I believe he gave you a big break.
NavigatorWife Thanks this.
