The answer to your question about your own authority is yes. Your situation won't affect that. If you are a one truck operation you may be your own DER. You will receive a notification from your consortium that you must test. Go WITHIN the time frame when you absolutely CAN give a sample. If you can't provide a sample you will still have to deal with the same problem because your consortium will tell you where to give it and the collection site is required to notify the MRO if a sample isn't collected for whatever reason.
Pertaining to post 14 I did have a truck leased to a company some time ago that had an onsite MRO. That is the only time since drug testing was initiated that I have ever seen it but it is possible. It is a huge headache but it probably would save some money over an outside consortium.CondoCruiser and fr8te_sh8ker Thank this. -
Go to this site and send a message http://www.truckersjustice.com/ Paul Taylor is a trucker's attorney and if there is a way to help you he will know what to do.
And if he can't help you then scrounge up $250 and go to www.dacfix.com who claim to have a 70% success rate in getting errors removed from DACs. You can't afford to not try and get the DAC fixed.need2drive Thanks this. -
One concern I have is what the OP should do next time--when this is all behind him--and there will be a next time as long as he can stay trucking. My thought is immediately have a blood test done even at your own expense. The lapse of time is otherwise not in OP's favor. So while the MRO has limitations and rules that guide him, at least the OP could get an blood test ASAP. To buttress his case and show that he's not and has not been under the influence of anything.
Now he needs to find out where and how he could do that. Next time. Where ever that might take place. Maybe a standing prescription from his Doc that he could take to any medical facility on short notice. -
Question if any one knows...can collection site be house or also employ the MRO as in the MRO is the doctor in the site facility
