Overweight questions

    I wish this was thought up but unfortunately i guess i'll write the court explaining the circumstances. Yes agree that owner operator was a broke ### but i work for a great company now. I've been driving many yrs never any issues like the company i worked for when i got the ticket. My point here is this overweight was shippers fault and was no scales to weigh load before weigh station. I'm not paying for something not my fault. Also i've heard they can't suspend ur license since it's not a moving violation. I've spoke to drivers who have said they never pay overweight tickets. If there is a warrant would only be in Missouri and i do nit go there with this company. I do appreciate all the advice thus far though.

    Three things
    1. Your name is on it.
    2. They will issue a bench warrent for your arrest.
    3. All states are interlocked now as part of Homeland security.
    You could be stopped in Ohio or Arizona and thewarrent will show on the officers screen. I dont know what that will mean for you at that moment but do you want to find out?
    When i started driving oilfield in tx i called the state police to find out if there was anything on my record i should be concerned with. They said there is a man in North Carolina with my same name and birth date who did not pay some fines and his license has been suspended in NC. The THP said that because of that suspension in NC i was also not permitted to drive in TX. I called NC and they told me if i sent them certain info including my ss number and $2.65 they could issue me a certified document that says i am not the same person. When i called CO DMV to see if Homeland Security backgroud came in formy Hazmat endorcement, they told me i need to bring in the SC document when i come to upgrade my lic. They also said i should cary it at all times (may i zee your peperz pliz).
    You will lose! Pay the fine! If it is big they will likely set up a payment schedule for you. Next pay a lawyer to write a letter to the guy who took your money. It might cost you a hundred bucks but they lawyer will know what to say and your money will most likely be returned to you in short order.
    You deffinately got screwed by others. Dont screw yourself on top of it.

    They OW isnt points. Not showing for court is a contempt of court charge. They didnt get Bill Clinton for screwing an intern, that wasnt a crime it was only embarassing. They got him for lying to Congress and that was a crime.

    You might try contacting an attorney where the court is located and see if he can appear for you or get the appearance delayed. Also call labor board or whoever till you find out how to file a complaint against the owner operator and the carrier. This will take time. He cannot take your money unless you signed a paper saying he could. They will crawl through the process but in some time you will probably get your back pay and the money he took out of your check to pay the fine. When I have been given overweight tickets in similar circumstances I stay at the scale house until it is paid. All I have is the load once I deliver the load the shipper has no motivation to pay the fine in my name.

    You should contact the courts and explain what happened. You will still probably have to pay the ticket. But from my experiance most courts will let you make payments with no interest. I know a driver that got a ticket and his boss was supposed to pay it. Two years later he was stopped in his personal car in another state and was taken to jail for it. He said it was a big ordeal from something he was told was taken care of. Even if you don't go back to Mo and pay it I do believe it will come back an haunt you another day.

    If you have been driving for awhile as you say you should be able to feel the difference in a light load vs a heavy load. DOT is looking at the weight on their scale. They don't care if the bills say 10 pounds or 40000 pounds.

    No i did feel load was heavy was gonna scale it but scalehouse came before i could. The shipper agreed to pay overweight so if true then company got paid with money meant to pay overweight ticket and pay me back. I could ask my current to help me but feel they shouldn't be involved not they're problem. I appreciate info even if not what i wanted to hear. Thanks

    first thing you should have learned in trucking is take care of all tickets yourself and follow up to make sure
