Yep I know been discussed many times even by me.........but you know, I like to prod folks and make you think......so chew on this:
We don't get O/T under FLSA blah blah blah and so on.......... but carrier mechanics are covered under the same rule ! Yes they are! So a carrier does not have to pay them O/T......but he does ( 90% of the time ) so why is that?
Why are we different? Why do we get screwed but the mechanics don't????
Do you suppose it's because mechanics won't work for him if he doesn't pay? But a driver will? Really?
Responsible rebuttal encouraged as always.....lemme have it!!

Some of the trucking companies around me have a separate company set up for the mechanics. Joe blow trucking and or joe blow truck repair. They also save on workers comp this way. Truck drivers pay a higher rate than mechanics .....
But I agree with you OT should be paid.... -
Well yeah but you, as a driver get to sleep in luxurious accommodations every night and engage in video-chats with your wife and kids. Mechanics on the other hand get grease under their fingernails every day and have to go to a dull, miserable home every day to a wife who may or may not have sex with them. Apples and oranges.

With 100% implementation of EOBR's, where a drivers time is supposed to be more accurately recorded, drivers pay could be changed to hourly with OT. It will take congressional action, but not entirely out of question.
With agreement on a suitable conversion, it will end up being beneficial to both sides.

Driver's aren't different from mechanics for overtime payment under FLSA; as you stated before you asked the question.
Some carriers do pay drivers overtime and some don't.
There is no reason to pay overtime. It's an artificial and arbitrary requirement. Some employers who do have to pay their employees overtime have to then pay their employees a lower straight time rate in order to be able to afford the overtime rate. So total compensation isn't likely to be affected for many workers than it would be without the law.

By any chance do you employ any of today's breed of truckload, irregular route drivers??? Obviously not because if you did you realize paying overtime after 40 hours/week is suicide for the carrier in today's trucking [reality] world. You'd be paying overtime for a simple run from Albuquerque to Edison during the months of Nov thru Feb and begging the shipper to make it right. Guess what? The shipper is not going to play that game.mje Thanks this.

I agree, This man also claims that drivers should pay to park at all truck stops... I originally thought he was a broker by the way he talks ( sense most brokers live in there own world ) but now I'm starting to think he was struck in his sleep by a shooting star and he won the lottery... I mean to state over time doesn't make sense and no drivers should get you just gotta wonder, where and the hell is my man coming from? Actually starting to think he must work or have stock in a puppy mill feeder company? Anyone else feeling my notion? So we get paid by the Mile yet we, sit for free at ship/receiver's, fuel, drop hook, pre/post trips.... and don't get paid... maybe we should drive the 62 mph turtles for free... ? atleast give us water to float in... please ( I don't have 62 mph truck... just saying!!!!!!!!!!!!!!!truckerdave1970 and mje Thank this.
