just a rant about 34hr restart

    How the heck is it that a driver can take 53hrs off and not get a dang restart I mean dang what the heck is up with that BS there needs to be some provision that give you one no matter what after 48hrs at least.
    Does DOT think I will be any more rested at 5am monday than I am at 3pm on sunday. Well guess what heck no between 5am and 7am I can hardly keep my eyes open no matter if I had been up 15 min or 5hrs just the way I am.
    Anways here is how you can have 50+ hrs and not get a reset last week I started a 5am (dang was it a pain but had to wait for the rest as many times I run close on my 70 by Friday night not knowing I would run so little during the week) ran till Thursday after noon around 3 or so Friday logged on to run trailer to yard(45 miles) to get its tire fixed and get new tires on my truck was done by noon. got in babysitter said I hade 52 hrs off I went picked up the trailer got there said 53hr 5min off duty on duty for PTI driving and away I went 322miles done 9pm sunday.

    It is just flipping amazing how having to wait one week for that reset can really screw up the next week and there is no way that one can wait till 5am and get 300 miles by 7am.

    Just think had I not had to drag the trailer to the yard I would have had another 21hrs off duty and still no reset who ever the heck thinks of these BS rules should be shot.

    Sorry I know the rules have been discussed many times before I just had to vent so I did not drive the truck straight though the next scale house I see this just pisses me off. As I have to jiggle a lot to make it work most my runs are not that long so its going to be one of them weeks I will have to turn down loads I should have been able to run.

    The hours of service are perfect for local work on a mon-fri or tue-sat schedule. For running around the country like a chicken with no head for weeks at a time this HOS are nonsensical, you might want to consider going loose leaf or just going to a weekly schedule that allows a reset every week in the comfort of your home.

    i have a monday to friday shift i will only let it go to go otr only if they change the hos if not i aint doing it how you spend 168 hours on a truck and you can only work 70 hours authorities aint got nothing to loose because they don't drive truck.

    I am an O/O that's leased on most of the time its no biggy I mean heck I am home every weekend usally early enough Friday that leaving on Sunday after 34 is no problem just week before last I did not get back till sat and had a big enough window I could wait till 5am Monday to leave. was home by Thursday after noon just ran the trailer to the yard Friday and back home so pretty much had Fri and Sat off left Sun about 3 so I could be here and have the 10 off before delivering at 7. So for the most part its ok not fighting to much with these but it is absolutely ridicules one can be off for 50+ hrs and not get a reset.

    Not that I agree with the new rule for many reasons but I can half way see the change to keep drivers from working 80+hrs in a 168hr period with a well placed restart which was what they were trying to prevent . But the lack of thought into it and not taking into account more than 48hrs off is just plain stupid by these well educated (ha ha ha) and smarter than the dumb truck drivers (yeah right) rule makers

    I told my dispatcher that I would only have 5 hours for the day. She said you need a restart then? I said no, that the next day I was getting 10 hours back and the following day over 11. I never take restarts when I'm out. Setting for a day and a half idling isn't in my game plan.

    Would this be a much better solution?
    Totally do away with the 34 hour restarts. Also, totally do away with the mandatory 30 minute break after 8 hours of driving.

    Also, revise the hours of service, (HOS), to read as this:

    keep the 14 hour work day - drive 11 hours a day 7 days a week totaling 77 hours a week of driving - keep the 10 hour a day break 7 days a totaling 70 hours a week.

    Do away with 14 hours and have every CDL holder work max 10 hours and make a livable wage.

    What they should do is just dump the stupid 70 hr rule and just have 11 and 14 hour rules.

    You are not alone on this subject. Whether a driver is on a 34 reset between 1-5am or 1-5pm makes no difference if you are getting proper rest. I do not see the Government holding police, firemen, doctors, nurses, etc who have safety sensitive jobs being held to the same standards as to when they must rest before returning to duty. There are more people who die in hospitals every year due to doctor and/or nursing errors than there are people who die in traffic accidents caused by a tired truck driver!

    Years ago I preferred driving at night and sleeping in the daytime. It was so much better when it came to finding a parking space at the truck stops and avoiding more traffic around big cities.

    No one should ever have to work 70hr weeks, baby sit a unit, sleep in the truck ( off duty unpaid ) and request to go home.

    Trucking is definitely weird.
