Motorcyclist Sues Truck Driver, Lemont Following Fuel Spill Accident

LEMONT -- Motorcyclist Greg DiMenna is suing the driver of a Mack truck and the Village of Lemont after he slipped on a patch of sand on a Lemont road following a fuel spill, causing his motorcycle to crash.

DiMenna was riding his motorcycle on April 17, 2007 near the intersection of New and Lockport avenues in Lemont when he attempted to make a right turn. DiMenna claims he lost control when his motorcycle hit a patch of sand left on the roadway after a clean up of fuel on the roadway, according to a suit filed in Cook County Circuit Court Thursday.

DiMenna claims the driver of a 1993 Mack Truck, Christopher Tokarski, carelessly operated his truck, allowed fuel from his truck to be released on the roadway and failed to warn motorists using the roadway of the hazard caused by the release of the fuel.

DiMenna claims he suffered severe and permanent injuries, incurred high medical costs following the crash and high costs associated with the damage of his motorcycle, the suit said.

He is also suing the Village of Lemont in the suit, claiming Lemont failed to properly maintain the roadway, properly clean up and maintain the intersection after a negligent and careless release of fuel. DiMenna also claims Lemont failed to properly notify motorists using the roadway that a dangerous condition existed.
