Here is a update on my story. I recieved my USIS(DAC) today. Low and behold they did report it as a accident/incident. Here is what it says:
Accident/Incident RecordEquipment was involved in an occurence or act that produced unintended injury, death, property damage of any type, or resulted in the equipment requiring a tow (other than mechanical breakdown) while assigned to the driver regardless of fault. Adverse information is reported for 7 years.
Number of DOT Recodable accidents less than 7 years old: 0
Number of Non Dot Recordable Accidents/Incidents less than 7 years old: 1

Now according to the wording USIS-other than Mechanical Failure. This should not have been reported on my DAC. I have a letter from my insurance carrier stating on such date they have no record of a accident claim. My logbook has no record of a accident occuring.
I'm ready to dispute this. I downloaded USIS dispute form and printed it out. I need help in wording a letter to USIS disputing the fact this was not a accident/incident. Just a mechanical failure in which I had no control over.
I would use DACfix but being unemployed at this time. Its not in my budget to spend $150. I think a proper letter correctly worded could get this removed from my DAC. Any offers or suggestions are appreciated. Please feel free to message me if you like. Thanks,

Definitely do what it takes to get this bogus BS removed. Understand that some companies will use DAC as sort of a weapon against you. This is to eliminate your choices on down the road, meaning you'll probably have to stay right where you are if they DACmark you. Yeah, believe it. These outfits will use DAC to help them solve their turnover problems. When they bust your DAC, you look less attractive to a competing carrier and may not be able to go elsewhere. You'll be stuck right where you are, holding their steering wheel and no one else's.
Good luck getting this off. I don't think you'll need that luck, as it should be fairly easy. But go in like a mad tiger. -
Employers are very limited in what they can say far as a passed employee.
Basically "would you rehire" question

I could be wrong but I am pretty sure that's all they could say. I was limited by a company I used to work for when I was about previous employees.
Far as DAC goes the entire reporting system is flawed and definitely is not a credible information system. Employers can report anything they want and have it effect you getting into a job with another company. You have to go threw a 30 day rebuttal which you may be out of work for the entire process's. Anybody at the company can report negative information on your DAC down to your dispatcher (we all know they tell the truth).
DAC should give you the opportunity to feud any information being reported "BEFORE" it goes onto your recored.
This would be a fair and almost accurate reporting agency unlike they currently have.
A tire blow out? that's just lame and never should be reported by DAC....
I had 3 blow outs within 3 months..... Does that mean I was lazy and did not check my equipment??????????????
(dislike people assuming its the driver as in other post being posted in this thread.)
Well let me tell you I do check my equipment, How about companies trying to save money and running poor tires on thier trailers.......?????????????? that would be my first assumption then to just to blame a driver.......
Company I worked for ran crappy tires on the trailers and had 3 blowouts... 110 degree heat across AZ and CAL did not help neither..
needless to say I don't work for that comp[any anymore... -

Well, I just got off the phone with USIS. She was a very nice lady. After a long 30 minute conversation with her. I learned a few things about what can be reported on your DAC. According to her, EVERYTHING and ANYTHING that happens on that truck your assigned to, is suppose to be recorded by the trucking company per DOT rules. That includes any accidents, incidents, and maintenance. No matter how minor they are.
Now its up to the trucking company what they choose to report on your DAC. If they want, they can report ANY and ALL accidents, incidents and maintenance failures. Whether they are preventable or non preventable. Breaking company policies can be reported. I could not believe this, when she told me this. I told her, I had two other tire blowouts with this company and they weren't reported. She told me I probably should be happy they didn't report them. She agreed with me about the reporting the mechanical failures but reminded me. They can report this if they want. If the trucking company has kept this on there files. They can put this on your DAC. She did tell me, not all companies do this. Some companies only report accidents but would not elaborate on which ones. Bottom line was, She said, If you sneezed wrong they can report it.
My conclusion. USIS is aware of these minor incidents being reported. They know its a gray area the companies can use. According to her, they know it needs to be changed. USIS is not the one to blame either. The trucking companies are the ones to blame. I was going to continue challenging this but after talking to this lady. Its not even worth hiring DACFIX. According to her about DACFIX. Its a waste of money. Because USIS does all the work, not DACFIX. I basically did what dacfix does and saved myself $150.(except for postage and my printer ink/paper) Also, If I did challenge this further. She said, I could end up having the other two tire blowouts reported by the company. She said, it has happened in the past.
MY RANT: I know this was only a tire blowout and I can still be hired by other companies. The whole idea of how they can ruin a CDL drivers career is beyond me. I'm not even sure if its worth driving truck anymore. I'm disgusted by how these companies in the trucking industry treat people.(and they wonder why they have a driver shortage) They use people and spit them back out. Then pull new victims in and the cycle continues. I don't just blame these trucking companies. I also blame OODIA, ATA and any other association out here. Who says they are for the drivers. They are the ones that can make the difference. I'm sure these associations are very aware of whats going on. They are sitting to the side and filling there pockets. I want to be a CEO/CIO of some association and collect a fat check. What is it going to take to change this industry?

Come on. You thought you live in a FREE country? Wake up. The USA is a paradox. People who are free still have to be ruled somehow, and in the USA, it's by market-instituted 'laws'. DAC is one example of that. It's no different from what you will see in a place like North Korea.
Take away a driver's freedom to work where he wants and for whom he wants and you'll have him shackled. Drivers who have no choices available to them in the land of free choices make a great pool of people to exploit. Welcome to the world of DAC. Again, I have to advise anyone who wants to get into trucking to explore other career avenues. I got out of trucking mainly because of DAC and the CDL regs. I dumped my class-A and don't plan on getting it back, at least not as long as DAC exists. -
Boy this company would have had a freaking field day with me in 1997. I was hauling turkey for Oscar Meyer weiners and had a wheel EXPLODE the RR inner rim broke at the hub were I could not have seen it in a pretrip at all then slammed into the outer and cut it. Took out the front axle tires also and cut the air lines on the trailer while doing 68 MPH lostthe other side at the same time.
I had to replace 8 tires 2 rims air lines and my shorts on that one. Yet this company that would DAC you in a heartbeat never did a thing to me. -
Remember corporate America? Lots and lots of big money, DAC a tool to control drivers, Oh yea, I believe. You can always jump ship and become a traitor, like I did, Class "B" family run, hourly pay, clean and good equipment and almost no BS. Anyway with two years you may be able to get something local or a smaller company, the bigger the company the bigger the headaches.
