The whole sleep apnea rule has been overruled until a study is complete. And it actually never became law anyway. Yet Concentra is still refusing to give overweight drivers a full Med Card until they have the sleep test.
In the past two months I have two friends that were given a 3 month med with instructions to go to a sleep clinic to be tested and then the company that they were hiring on with turned them down for not getting a 1 year card.
I have read every long form I can get my hands on and I see nothing about BMI or Neck size. Seems they write it in the comments section.
The greedy ######## have got to be sued.

It could be a company specific request.
A company "MAY" have higher standards than those required by the FMCSA. If they tell Concentra to give a 3 month card until a sleep study has been done, Concentra does it. The company is paying them to perform the physical, so your input is irrelavant.

Most everyone would agree with the greedy ######## part.

Not an attempt to be insensitive but, if one has sleep apnea caused by being overweight, maybe one should get the weight problem under control.

If body mass is within acceptable clinical parameters and sleep apnea is still present then a case can be made.

Otherwise the suit is not justifiable.

Two words: ELIMINATE SUGAR. Get that out of your diet, add probiotics to rebalance the ecosystem of your GI tract, and pounds melt away.

Regarding the potential for a lawsuit, unlikely to be successful. Although I'm sure there's plenty of lawyers that would love to have some billable hours.

There are a bunch of driver's that have sleep apnea and don't know it yet or are in denial. As it progresses there are things like hypothyroidism and diabetes that are directly related. These doctors have nothing to gain by your friends getting tested. Your whole basis is you met two people with the same problem. Truth be known as many as 50% of drivers have it because of the lifestyle of sitting in a seat and munching on junk food all day. Finding two possible candidates is not hard at all. I can stand at a truckstop and pick 20 out in an hour. It isn't a conspiracy. It's an advancement in the medical world that is bringing awareness.

The crookedness doesn't start until you get to the Respiratory Therapist and have to buy the Cpap! :)

Schneider is a leader in how this should be done. THEY cover the cost of everything. IF diagnosed , they issue a loaner machine until insurance picks up the full cost , would only be charged for the machine if you left their employment before a year was up. Then every 6 months a box of supplies shows up at your door from the company contracted to monitor compliance and work with the driver for any issues. They send email a compliance letter and usage data whe it comes time for med card renewal. All at no cost to the driver.

For myself , I was diagnosed prior to getting my CDL. Absolute life saver for sure. My opinion, if you have any doubts about any of this, work with your primary care doctor. BMI and weight can be indicators but there are far more accurate indicators for a doc to recommend getting a study done. If your doc says its not warranted then they should be willing to put that in writing.

My wife and I were both tested.. I have sleep apnea and she was told that she did not...

this subject has been discussed in great detail and most people who comment about it here are completely ignorant about the entire condition...

1.. weight does not cause sleep apnea.. sleep apnea in fact can cause one to gain weight because your body is not getting the proper rest which throws your whole system out of balance..

    2. Being thin and in shape does not rule you out as a candidate for sleep apnea.. in fact the Neurologist who performed my sleep study said it is an even mix when it comes to diagnosing people with it. He said he has tested people well over 400 pounds who did not have sleep apnea.

    3. Sleep apnea is a very serious health condition that is only recently being understood and should not be described as a scam simply because you do not understand it. If someones life is saved as a result of being tested then it is worth it. And yes people can and have died from this. In 1999 my wife passed away in her sleep at 45. The doctor at that time said that she was perfectly healthy but sometimes people stop breathing in their sleep for no apparent reason
Now we know that there is a reason for it "sleep apnea".

Please educate yourself before you start condemning doctors and companies...many companies pay for the testing and the equipment as did the company I was working for at that time. I still have the cpap machine today even though I no longer work for them.
